Portion of Trail 038 Converted to Non-Motorized Travel Only

After a review of public comments, the Tongue District Ranger has decided to convert a portion of Trail 038 (approx. 4.5 miles) from a designation of motorized to non-motorized.  The affected section extends from Kearny Lake (Forest System Road 320) to the intersection with Trail 033 (see map).

This decision is categorically excluded from further analysis and documentation in an environmental assessment or environmental impact statement because there are no extraordinary circumstances related to the proposed action.  This action is excluded under 36 CFR 220.6 (d) (1) “Prohibitions to provide short-term resource protection or to protect public health and safety” (FSH 1905.15 Chapter 31.12 (1). 

This action will improve public safety by designating a trail that was initially designed for and has been historically managed for hiking and pack stock as a non-motorized trail.  This portion of the trail is too narrow and rocky to allow for safe use by motorized vehicles.  Further, this action will limit erosion and damage to natural resources resulting from motorized use on trails which are designed only for hiking and pack stock.
