FOREST SUPERVISOR’S ORDER

Pursuant to Title 36 Code of Federal Regulations 261.50(b), the following act is prohibited as described below with the Ninemile Ranger District of the Lolo National Forest. This restriction is in addition to those enumerated in Subpart A, Part 261, Title 36, Code of Federal Regulations, and becomes effective on July 15, 2015 and will remain in effect until December 1, 2015.

36 CFR – National Forest System Roads

It is prohibited to be on the road. [36 CFR 261.54(e)].

The closure cited in this order is to protect the public from potential harm from timber harvest operations associated with the South Fork Fish IRSC.

Description of Closed Road:

Owl Creek Road, National Forest System Road (NFSR) 5570, shall be closed from milepost 0.00, its junction with Fish Creek Road 343 (section 5, T. 12N., R. 24 W.), to the end of the road. This includes all roads accessed by Owl Creek Road.

Exemptions:
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:

1. Persons with a permit specifically authorizing the prohibited act.
2. Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty.
3. Employees of Tricon Timber Company and their subcontractors.

Penalty: Violation of these prohibitions is punishable by a fine of not more than $5000 for and individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both (16USC 551 and 18USC 3559 and 3571).

Notification: A copy of this order shall be posted as prescribed in 36 CFR 261.51.
