FOREST SUPERVISOR’S ORDER
Pursuant to Title 36 Code of Federal Regulations 261.50(b), the following act is prohibited as described below with the Ninemile Ranger District of the Lolo National Forest. This restriction is in addition to those enumerated in Subpart A, Part 261, Title 36, Code of Federal Regulations, and becomes effective on September 25, 2015.
36 CFR – Special Closures - Property
It is prohibited to go into or be upon any area which is closed for the protection of property [36 CFR 261.53(f)]
The closure cited in this order is to protect the historic structures and other property of the Ninemile Remount Depot and historic Ninemile Ranger Station, as well as to ensure the safety of the employees, residents and property of the compound. Closure is in effect from 10pm to 6am each day.
Description of Closed Property:
Property closed to public entry from 10 pm – 6 am each day
The Ninemile Remount Depot and historic Ninemile Ranger Station included in this order encompasses the Ninemile visitor center, administrative buildings, and three residences (e.g. quarters) within T15N R22W, Section 8 and a small portion of Section 9. The compound is delineated by a fence line, and is bordered on two sides by roads: the Ninemile Road to the south and the Remount Road to the east. MAP
Exemptions:
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:
- Persons with a permit specifically authorizing the prohibited act.
- Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty.
- Current USDA Forest Service employees or volunteers.
- Persons residing in the Ninemile quarters per agreement with the Forest Service are exempt from this order (e.g. tenants). Additionally, those individuals expressly invited onto the premises by a tenant of the compound are authorized to be within the closure order area, though the tenant retains responsibility for ensuring his/her actions do not result in destruction of property nor a compromise of the health and safety of other tenants.

Penalty: Violation of these prohibitions is punishable by a fine of not more than $5000 for and individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both (16USC 551 and 18USC 3559 and 3571).
Notification: A copy of this order shall be posted as prescribed in 36 CFR 261.51.
