Pursuant to Title 36 Code of Federal Regulations (CFR) 261.50(a) and 261.50(b) the following acts are prohibited within the Lolo Pass Winter Recreation Area (LPWRA-as shown on the attached map), of the Lochsa-Powell Ranger District, within the Nez Perce-Clearwater National Forest as described in this order and shown on the attached map incorporated into this Order as Exhibit A the Described Roads,Trails and Areas. PROHIBITIONS National Forest System Roads 1. Use or operation of an over-snow vehicle (OSV) or wheeled mode of transportation on National Forest System Road (NFSR) 5950, within the LPWRA. (36 CFR 261.54(a)(b)) Use of Vehicles off National Forest System Roads 1. Possessing or using a vehicle off NFS roads within the LPWRA, other than on upon a designated Multi-Use Snow Trails or within the boundaries of Packer Meadows Play Area. (36 CFR 261.56) National Forest System Roads and Trails 1. Operating an OSV in violation of the posted speed limit within the LPWRA. (36 CFR 261.54(d) and 261.55(d)) 2. The use or operation of snowshoes, OSVs, or wheeled modes of transportation on designated XC ski trails in the LPWRA. (36 CFR 261.54(a) and 261.55(c)) 3. The use or operation of a motor vehicle over 50 inches in width or any wheeled motor vehicle upon Multi-Use Snow Trails within the LPWRA, unless signed as otherwise. (36 CFR 261.54(a) and 261.55(c)) Order Number 01-17-55-23-008 2 Occupancy and Use 1. Parking or leaving a vehicle in violation of posted instructions within the LPWRA. (36 CFR 261.58(g)) 2. Being in possession of a dog, other than a service dog, within the LPWRA other than within the paved Lolo Pass Visitor Center parking lot section, when it is not crated, caged, or upon a leash not longer than six feet, or otherwise under physical restrictive control. (36 CFR 261.58(s)) 3. Being upon any building roof within the LPWRA. (36 CFR 261.58(b)) EXEMPTIONS: Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order: 1. Persons traveling through with a dog(s) for hunting when the dog(s) stays upon or within the OSV while in the LPWRA. 36 CFR § 261.50(e)(6) 2. Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this Order. 36 CFR § 261.50 (e)(1). 3. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty. 36 CFR § 261.50(e)(4). DESCRIBED AREA/ROADS/TRAILS The Lolo Pass Winter Recreation Area (LPWRA) – Beginning at the junction of US Highway 12 and Packers Meadow Road #373 in Section 16, T38N, R15E, east along Packers Meadow Road #373 to the junction with Lee Road #5950, north along Lee Road #5950 to the MontanaIdaho state border, east along the north section line of section 15 and 14 to junction of Packers Meadow Spur Road #5951, south along Packers Meadow Spur Road #5951 to the junction of Packers Meadow Road #373, east to south east along Packers Meadow Road #373 to junction of National Forest System (NFS) Road #5956, south along NFS Road #5956 to the junction of the east section line of section 14, south along east section line of section 14 to the south east corner of section 14, west along south section lines of sections 14 and 15 to the junction of Mt. Fugi Road #5955A, south to south west on Mt. Fugi Road #5955A to junction of east section line of section 21, straight west to junction with US Highway 12, north along US Highway 12 to junction with Packers Meadow Road #373. Packer Meadows – East of junction of Packers Meadow Road #373 and Lee Road #5950, South of Packers Meadow Road #373, West of Ski Trail on East side of Packer Meadows, and North of Pack Creek. Packer Meadows is within the boundaries of the Lolo Pass Winter Recreation Area. 3 Order Number 01-17-55-23-008 PURPOSE These restrictions are necessary to protect public health and safety, ensure the safety of motorized and non-motorized recreation users, and to help maintain and protect the groomed, motorized and non-motorized, winter trails from prohibited uses, within the Lolo Pass Winter Recreation Area. IMPLEMENTATION 1. This order will be in effect from December 12th , 2024 at 12:01 a.m., through April 1st, 2025 at 11:59 p.m. This order expires 12:01 a.m. on April 2nd, 2025. 2. These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart 3. A map identifying the Described Road is attached and made part of this Order as Exhibit A. Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions. 5. Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571 and 3581(b)(7). 6.
