Programmatic Agreement - National Historic Preservation Act Undertakings

The Black Hills National Forest Intends to Develop a Programmatic Agreement to Govern National Historic Preservation Act Section 106 Undertakings

The Black Hills National Forest (Forest) intends to develop a Programmatic Agreement (PA) with the South Dakota State Historic Preservation Officer, the Advisory Council on Historic Preservation, and interested Tribal governments that express a desire to participate.  This notice provides an invitation to other interested parties to participate in the drafting of the agreement as Concurring Parties.

 Participating parties share a common desire to develop a flexible programmatic approach for expeditiously implementing Section 106 of the National Historic Preservation Act that will satisfactorily take into account the effects of common Forest Service undertakings on historic properties, including archaeological sites and historic structures.

 A PA of this nature helps the Forest to more efficiently implement projects of a similar and repetitive nature (pursuant to 36 CFR §800.14(b)(1)(i)).  In addition, this PA will be used where routine management activities are undertaken by the Forest (pursuant to 36 CFR §800.14(b)(1)(iv)).
