DB-01-15: Developed Recreation Area Prohibitions



Pursuant to the provisions of 16 U.S.C., Section 551, and Title 36 C.F.R., Part 261.53(e), 261.58(a), 261.58(c), and 261.58 (f) to provide for visitor safety in the developed recreation areas, I am prohibiting the following acts:

LOCATION: The portions of National Forest System lands within the developed recreation areas of the Daniel Boone National Forest in multiple counties in Kentucky. The area is further described in the attached map and list of names where the prohibitions are applicable.

EFFECTIVE DATE: This Closure Order is in effect February 24, 2015 and continues until rescinded.


Displaying a firearm within a developed recreation site except forcleaning and or transporting to and from vehicle (36 CFR 261.53(e));

Camping or maintaining a campsite in a developed recreation area for more than 14 consecutive days without having first terminated occupancy of that campground for a minimum of 10 days within a 31 day time frame (§261.58(a));

Entering or remaining in a designated campground between the hours of 10:00 p.m. Eastern and 6:00 a.m. Eastern except for persons occupying the campsite (§261.58(c));

In a developed site occupying a single camping unit by more than six (6) persons and a double unit by more than twelve (12) persons (§261.58(f)).

Pursuant to 36 C.F.R. 261.50(e), the following persons are exempt from this Order:

Any Federal, State or Local Officer, or member of an organized rescue or firefighting force engaged in the performance of an official duty;

Any authorized person engaged in official administrative duties regarding National Forest Administration;

Persons with a permit specifically authorizing the otherwise prohibited act or omission.

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A. Executed in Winchester, Kentucky this 24th day of February, 2015.

Violations of the above prohibition set forth are punishable by a fine of not more than $5,000 for an individual and $10,000 for an organization or imprisonment for not more than six (6) months or both. See 16 U.S.C. 551, 18 U.S.C. 3559 and 3571.
