FOREST SUPERVISOR’S ORDER
ROCK CREEK DRAINAGE

Pursuant to Title 36 Code of Federal Regulation 261.50(a) and (b), the following acts are prohibited as described below, within the Rock Creek drainage on the Missoula Ranger District on the Lolo National Forest in Granite and Missoula Counties, Montana. This restriction is in addition to those enumerated in Subpart A, Part 261, Title 36, Code of Federal Regulations and becomes effective upon signing and will remain in effect until rescinded.

This Forest Supervisor’s Order rescinds Order No. F10-006-LOLO-D3 dated March 15, 2010.

Prohibitied Acts:

36 CFR 261.53(f) – Special Closures - Property

Firewood cutting is prohibited from October 1 to April 30 on the National Forest lands described below.

Area Description:

Firewood Restriction: All Lolo National Forest land ¼ mile either side of Rock Creek Brewster Creek and Ranch Creek and ¼ mile either side of National Forest System Roads 4308, 4296 and 102 as described below:

  • Brewster Creek and Road 4308 from the Brewster Creek Road 4308 / Rock Creek Road 102 intersection east to mouth of the North Fork of Brewster Creek in the SW ¼ NW ¼ Seciton 14 T10N R16W,
  • Ranch Creek and Road 4296 from the Ranch Creek Road 4296 / Rock Creek Road 102 intersection south and east to the National Forest /Private land boundary in NE ¼ NE ¼ Section 6 T9N R16W, PMM and
  • Rock Creek and Road 102 from the Rock Creek Road 102 / Ranch Creek Road 4296 intersection south to the Lolo / Beaverhead-Deerlodge National Forest boundary in the SW1/4 SW¼ Section 8 T7N R16W, PMM,

36 CFR 261.56 – Use of Vehicles Off National Forest System Roads

Possessing or using a motorized vehicle in cross country travel off Rock Creek Road 102, Valley of the Moon Road 34, Brewster Creek Road 4308 or Ranch Creek Road 4296 for any purpose except to drive on existing travelways to Forest Service designated campsites and campgrounds (36CFR 261.56).

 

 

36 CFR 261.58 – Occupancy and Use

Camping outside designated Forest Service campsites and campgrounds along Rock Creek and Rock Creek Road 102, Valley of the Moon Road 34, Brewster Creek Road 4308 or Ranch Creek Road 4296 (36CFR 261.58(e)).

Camping more than 50 feet from steel fire rings at designated Forest Service dispersed campsites along Rock Creek and Rock Creek Road 102, Valley of the Moon Road 34, Brewster Creek Road 4308 or Ranch Creek Road 4296. (36CFR 261.52(a) and 36CFR 261.58(e)) Steel firerings referred to in this Order are those placed by the Forest Service.

Building campfires outside steel fire rings along Rock Creek and Rock Creek Road 102, Valley of the Moon Road 34, Brewster Creek Road 4308 or Ranch Creek Road 4296. (36CFR 261.52(a) and 36CFR 261.58(e)) Steel firerings referred to in this Order are those placed by the Forest Service.

Area Description:

Off Road Vehicle Use and Camping / Occupancy and Use restrictions: All Lolo National Forest land ¼ mile either side of Rock Creek and ¼ mile either side of the following roads: Rock Creek Road 102, Valley of the Moon Road 34 (from the Valley of the Moon Road 34 / Rock Creek Road 102 intersection south and west to the Lolo National Forest / Private land boundary in SW ¼ SW ¼ Section 19 T11N R16W), Brewster Creek Road 4308 (from the Brewster Creek Road 4308 / Rock Creek Road 102 intersection east to mouth of the North Fork of Brewster Creek in the SW ¼ NW ¼ Seciton 14 T10N R16W) and Ranch Creek Road 4296 (from the Ranch Creek Road 4296 / Rock Creek Road 102 intersection south and east to the National Forest /Private land boundary in NE ¼ NE ¼ Section 6 T9N R16W, PMM. Refer to two attached maps:entitled Rock Creek Restricted Area 2008 (one for north Rock Creek and one for south Rock Creek areas)


Exemptions:

Pursuant to Title 36 CFR 261.50(e), the following are exempt from this restriction:

1. Persons with a permit issued by a forest officer specifically authorizing the otherwise prohibited act or omission.
2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
3. Persons gathering or in possesion of 1/10 cord or less of firewood gathered from dead down material to be used within the area described above for a camp fire at a designated fire ring.

Penalty:

Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both (16 USC 551 and 18 USC 3559 and 3571).

Notification:

A copy of this order shall be posted as prescribed under 36 CFR 261.51.
