Forder Order No. 05-07-00-23-15 Special Closure LPNF October 31, 2023

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a) & (b), and to provide for public health and safety, the following acts are prohibited within the Los Padres National Forest. This Order is effective from OCTOBER 31, 2023, through JANUARY 31, 2024.

  1. Entering or using the following developed recreation sites or portions thereof:
    1. Monterey Ranger District sites as identified in Exhibit A;
    2. Santa Lucia Ranger District sites as identified in Exhibit B;
    3. Santa Barbara Ranger District sites as identified in Exhibit C; or
    4. Ojai Ranger District sites as identified in Exhibit D.

  1. Being on the following National Forest System trails:
    1. Monterey Ranger District trails as identified in Exhibit A;
    2. Santa Lucia Ranger District trails as identified in Exhibit B;
    3. Santa Barbara Ranger District trails as identified in Exhibit C; or
    4. Ojai Ranger District trails as identified in Exhibit D.

36 C.F.R. § 261.55(a).

  1. Being on the following National Forest System roads:
    1. Monterey Ranger District roads as identified in Exhibit A;
    2. Santa Lucia Ranger District roads as identified in Exhibit B; or
    3. Ojai Ranger District roads as identified in Exhibit D.

  1. Using a motorized vehicle on the following National Forest System roads:
    1. Monterey Ranger District roads as identified in Exhibit A;
    2. Santa Barbara Ranger District roads as identified in Exhibit C; or
    3. Ojai Ranger District roads as identified in Exhibit D.

36 C.F.R. § 261.54(a).

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

  1. Any Federal, State, or local officer, or member of an organized rescue or fire-fighting force in the performance of an official duty;
  2. Persons with a Forest Service non-recreation special use authorization, such as for electric transmission lines and associated facilities, oil or gas pipelines and surface operations, or communications sites and tenants;
  3. Commercial recreational special-use permit holders are exempt from Prohibition 1 above to the extent necessary to conduct site and facility clean-up and maintenance.
  4.  Persons with a non-special use Forest Service written authorization to conduct non-recreational activities including, but not limited to hazardous fuels reduction, habitat/ecological restoration, research, resource surveys, or grazing livestock activities;
  5. Owners, lessees, or residents of private land adjacent to or within the National Forest Boundary, to the extent necessary to access their properties;
  6. Owners, lessees, or residents of private land adjacent to or within the National Forest Boundary and Recreation Residence special-use permit holders (use code 123) of the “Oso Tract” on the Santa Barbara Ranger District are exempt from Prohibition 4b above to the extent necessary to gain access to their privately owned assets and restricted to their permitted uses or circumscribed parcels; and
  7. Persons with a Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order.

These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.

A violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 U.S.C. § 551 and 18 U.S.C. §§ 3559, 3571, and 3581.
