How to Apply

The process of applying for a Special Use Permit involves the following seven steps:

Pre-application Steps

  1. Self review of proposal using Forest Service criteria (see below);

  2. Contact the local Forest Service office to discuss your proposal (before working out all the details);

  3. If your idea meets the criteria, submit a proposal;

  4. Forest Service review of proposal;

Application Submittal Steps

  1. If proposal is accepted, then submit an application;

  2. Forest Service review of application;

  3. Acceptance or Denial of application.
     

Step 1:
Conduct a self-evaluation of your proposal using the following criteria:

NOTE: Proposals for commercial vending operations or motorized guide services are currently not accepted. Applications for these services will only be accepted through a competitive process initiated by the Forest Service.

Examples of vending operations include: coffee shops, hot dog stands, OHV repair services or clothing sales.

  1. Use consistent with laws, regulations, orders, policies of NFS lands, other federal laws and applicable with State and local health and sanitation laws.

  2. Use consistent or can be made consistent with Forest Land Resource Management Plan's.

  3. Use does not pose serious or substantial risk to public health and safety.

  4. Use does not create an exclusive or perpetual right of use or occupancy.

  5. Use does not unreasonably conflict or interfere with administrative use, other scheduled or existing authorized uses or adjacent non-NFS lands.

  6. Proponent does not have a delinquent debt owed to the Forest Service.

  7. Use does not involve gambling or provision of sexually oriented commercial services.

  8. Use does not involve military or paramilitary training/exercises by private organizations or individuals.

  9. Use does not involve disposal of solid waste, radioactive waste or other hazardous substances.

  10. Use is not a commercial vending operation or motorized outfitting guide service unless an official competitive bid process is in progress

Step 2:
After conducting the self-evaluation, contact the local Forest Service office to discuss your proposal.

A staff member will discuss your proposal, potential land use conflicts, application procedures and qualifications, probable time frames, fees and bonding requirements, additional coordination with other agencies, environmental reports, and field reviews.

Step 3: If, after reviewing the self-evaluation criteria and discussing your idea with Forest Service personnel, you feel your proposal will meet the first level screening, submit a proposal to the Ranger District. Proposal must include the following:

  1. Proponent name

  2. Nature of proponent - individual, partnership, corporation, government agency

  3. Technical and financial capability

  4. Project description and location.

If the proposal does not pass initial screen, the proponent will be notified. If the proposal does pass, the following will occur:

Step 4:
District personnel will screen the proposal using the criteria listed in step one as well as the following:

Local Administrations Rules:
Vending Permits and motorized outfitting guide applications will only be accepted during requests for proposals/prospectuses initiated by the Forest Service.

  1. Inconsistent or incompatible with purposes for which lands managed or with other uses.

  2. Use not in the public interest.

  3. Proponent not qualified.

  4. Proponent lacks technical or cannot demonstrate technical or economic feasibility or, financial or technical capability to comply with terms and conditions.

  5. No person or entity to sign or be willing to accept responsibility.

Steps 5-7:
Application Submittal, Review, Acceptance or Denial:

If the proposal passes the screening criteria, an application can be submitted, which will be reviewed using the same criteria as listed above.

The proponent will be notified whether the proposal and/or application are accepted or not.

Submitting an Application

  1. Complete the Pre-application Steps listed above.

  2. Contact the Forest Service office where your activity is located [where is this?] and request an application.
    You will receive an application, depending upon your requested use.

  3. Reminder: Prior to submitting the application, you are encouraged to arrange a pre-application meeting at the local Forest Service office where the use is being requested. A staff member will discuss your proposal, potential land use conflicts, application procedures and qualifications, probable time frames, fees and bonding requirements, additional coordination with other agencies, environmental reports, and field reviews.

  4. Commercial uses require additional information with the application such as liability insurance, licenses/registration, business plans, operation plans, or other documents. Additional environmental analysis may be required which entails lead time.

  5. Complete and submit the application form, including supporting documents, to the local Forest Service office. An incomplete application could delay the processing.
