Forest Order 14-12-02 - Bagley Fire Emergency Closure, Amendment 5

SHASTA-TRINITY NATIONAL FOREST
BAGLEY FIRE EMERGENCY CLOSURE
AMENDMENT 5

Pursuant to 16 USC 551 and 36 CFR 261.50(a) and (b), and to provide for public safety, the following acts are prohibited within the Shasta Lake and McCloud Ranger Districts of the Shasta-Trinity National Forest.  This Order is effective from August 25, 2012, and revised as Amendment 1 on August 27, 2012, and revised as Amendment 2 on September 11, 2012, and revised as Amendment 3 on October 1, 2012, and revised as Amendment 4 on May 2, 2013, and revised as Amendment 5 on December 12, 2013 until the Bagley Fire Order has been rescinded. The closed area described in this order will be consistently evaluated and modified based on road and hazard tree conditions from storms and wildfire severity in the affected areas of the Bagley Fire Incident.

Going into or being upon National Forest System lands within the Bagley Fire Closure Area.  The Bagley Fire Closure Area begins at the intersection of the township line between Townships 36 North and 35 North, Range 2 West, Mt. Diablo Base and Meridian and Squaw Creek; then continues northerly along Squaw Creek to the confluence of Squaw Creek and East Fork of Squaw Creek; then continues easterly along the East Fork of Squaw Creek to the section line between Sections 26 and 27 Township 36 North, Range 2 West, Mt. Diablo Base and Meridian; thence southerly along the section line to the section corner of Sections 26, 27, 34 and 35 Township 36 North, Range 2 West, Mt. Diablo Base and Meridian; then continues east along section lines to its intersection with Forest Road No. 35N46, then continues north along Forest Road No. 35N46 to its intersection with Forest Road No. 36N83, then continues north along Forest Road No. 36N83 to its intersection with Forest Road No. 37N34, then continues north along Forest Road No. 37N34 to its intersection with Forest Road No. 37N78, then continues west along the road edge furthest away from Iron Canyon Reservoir of Forest Road No. 37N78 to its intersection with Forest Road No. 38N11, then continues north along the western edge of Forest Road No.38N11 to its intersection with the south riverbank of the McCloud River at the confluence with Hawkins Creek, then continues along the south riverbank of the McCloud River to its intersection with the section line between Sections 5 and 6 of Township 37 North, Range 2 West, then continues south along section lines to its intersection with Forest Road No. 35N18, then continues south along Forest Road No. 35N18 to its intersection with Forest Road No. 35N56, then continues along the eastern edge of  Forest Road No. 35N18 to its intersection with the township line between Townships 36 North and 35 North, Ranges 2 and 3 West, Mt. Diablo Base and Meridian; then continues easterly along section lines  back to the starting point, as shown on Exhibit A.  36 CFR 261.53(e).

  • Being on any National Forest System trail within the Bagley Fire Closure Area, as shown on Exhibit A.36 CFR 261.55(a).
  • Being on any National Forest System road within the Bagley Fire Closure Area. Additionally, Forest Road Numbers 37N43, 37N50, 37N51Y, 37N37, 37N45, 37N45A, 38N11F, 38N60, 37N48, 38N11C, are closed as shown on Exhibit A. 36 CFR 261.54(e).

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:

  • Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.
  • Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  • Owners or lessees of private land in the Bagley Fire Closure Area to the extent necessary to gain access to their land.
  • Persons who reside on private land in the Bagley Fire Closure Area to the extent necessary to gain access to their residences.
  • Persons engaged in a business, trade, or occupation in the Bagley Fire Closure Area.

These prohibitions are in addition to the general prohibitions found in 36 CFR Part 261, Subpart A.

A violation of these prohibitions is punishable by a fine of not more than $5,000.00 for an individual or $10,000 for an organization, or imprisonment for not more than six (6) months, or both. 16 USC 551 and 18 USC 3559, 3571 and 3581.
