This
letter and enclosure supersedes the March 2, 2004 (File Code 5400/7300)
letter regarding lead based paint (LBP) in facilities being conveyed
under the authority of the Pilot Program Authorizing Conveyance
of Excess Forest Service Structures (16 U.S.C 580d, P.L. 107-63,
Sec 329 (a) as amended). It also addresses the required notification
of the existence of asbestos containing materials (ACM) and the
requirement to obtain written assurances from transferees.
Under the Forest Service Facility Realignment and Enhancement
Act of 2005 (FSFREA) (Title V of P.L. 109-54), mitigation and abatement
of these potential hazards are not required. However, if the administrative
site has LBP or ACM, the FSFREA requires that the Forest Service
provide notice of the LBP/ACM to the transferee and obtain written
assurances from the transferee that the transferee will comply
with
applicable Federal, State, and local requirements relating to LBP/ACM
management, including any applicable demolition and disposal requirements.
The enclosed document is to be used in meeting the minimum notification and written assurance
requirements for transfer of facilities under the FSFREA.
