13 - ORGANIZATION

13.11a - Lines of Authority and Responsibility (B6.1) Only personnel with a written delegation of authority will be assigned work on a timber sale contract. The authority given by the Contracting Officer or Forest Service Representative (FSR) must be exercised by the individual to whom it is assigned. Timber Sale Contract authorities are assigned to individuals, not positions. No individual has the authority to sign for, or as acting, for another individual. The assignment of authority and the responsibility of performance go hand-in-hand. All decisions made by these individuals within their respective assigned authority are final and binding on the Forest Service, and shall not be overturned, except by actions under provision C9.2 Disputes, initiated by Purchaser.

Under C6.1, Forest Service Representatives must delegate authorities to Sale Administrators, Engineering Representatives, Construction Inspectors, Harvest Inspectors, and any other personnel taking action on a Timber Sale Contract. Individuals assigned sale administration duties must be certified under the Region 6 Certification Program or work directly under the supervision of a certified individual. All agreements, waivers of contract provisions, and substitutions shall be in writing and signed by individuals from both parties who hold the authority to make the agreement.

Individuals assigned specific responsibility, even though responsible for a decision, may need to consult with specialists in order to fulfill that responsibility and satisfactorily protect the resources, meet objectives of the sale, and intent of the contract. Any changes made during contract administration, that change a decision made in the Environmental Analysis, requires a correction to the Environmental Analysis and new decision issued.

The line of authority for Timber Sale Contract Administration on the Gifford Pinchot National Forest is as follows. Communication and coordination between Line Officers and other specialists are expected to take place as needed.

Following are contract provisions which authorize or require specific action by the Forest Service. The lowest level a specific action or authority may be delegated is shown in the following table. The levels shown in the table are for fully functioning journeyman sale administration personnel. It is intended that the levels of authority not be routinely given to sale administration personnel. The FSR's making the delegation are to review and consider the specific qualifications of the personnel to whom they are delegating authority. It is expected that delegations of authority to trainee or Harvest Inspector positions be commensurate with the delegate's demonstrated performance. However, this does not perclude the use of Harvest Inspectors as outlined in FSH 2409.15, Section 04.5. These delegations apply to the 2400-6 and 6T Contract Provisions. For 2400-3 contracts, the delegations apply to similar provisions.

In accordance with Special Contract Provision C6.1, this is to inform you that I am designating ____________________________ as a Construction Inspector-In-Training (CIIT) for the subject timber sale contract. The CIIT will be working under the direct, on the ground, supervision of the designated Inspector or ER. Training will be provided in the complexities of contract field inspection, administrative requirements, contract documentation, and inspection methods and procedures.

The responsibilities of the Construction Inspector-In-Training are:

1.Read and become familiar with the contract, concentrating on the specifications and plans.

2.Read and become familiar with all other documents associated with the contract, including any Environmental Analysis and project design prescriptions.

3.Maintain a project daily diary of all occurrences or developments which happen while the CIIT is on the project.

4.When the CIIT observes activities which are apparently are not in compliance with the terms of the contract the CIIT will immediately notify the designated inspector or ER.

5.The CIIT will refer all questions regarding this contract to the Designated Inspector, or to the ER.

All dealings with the contractor, including Notices of Non-compliance and contract changes, are the specific responsibility of the Inspector, the ER, the FSR, or the Contracting Officer.

13.2 - Attitudes and Actions for Sale Administration. - Inspections are to be conducted as often as needed to insure that all resources are protected and to insure that the purchaser is in compliance with the Timber Sale Contract.

Sale administration personnel are to inspect sale operations and shall refrain from supervising purchaser's employees on timber sales. Timber sales that contain Provision C6.1 require the purchaser to provide daily supervision to the sale area when operations are in progress, see Chapter 11.12.

When inspecting sale areas, sale administration personnel shall request the Purchaser's Field Representatives to accompany them. Sale administration personnel shall insist that purchasers provide all direction to their personnel (misinterpreted instructions from Forest Service personnel could result in claims against the Government).

Sale administration personnel shall document every visit to active sale areas, when the visit was in conjunction with sale administration duties or responsibilities. The time the Sale Administrator/Inspector arrived on the sale area and the time they left the sale area will be recorded on the inspection reports. The inspection reports shall be completed, discussed, and signed by both parties, before leaving the sale area.

If signatures are not available, the Inspector must state why they are not, state "signature not available" in the appropriate place, and indicate who a copy of the inspection report was left with. Timber sale inspections will not be mailed to purchasers for signatures.

Sale administration personnel shall document when other personnel accompany them or are observed on the sale area. When strangers are observed on the sale area, sale administration personnel will also document vehicle descriptions, license numbers, and any other pertinent information.

The original copy of all inspection reports are to be forwarded to the Contracting Officer within three days.
