FOREST ORDER

 

Road Closure

 

Pursuant to 16 U.S.C. § 551, 36 C.F.R. § 261.50(b) the following act is prohibited on the Sioux Ranger District, Custer Gallatin National Forest, National Forest System Road #3089:

PROHIBITION:

 

1.  Being on the Road [36 C.F.R. § 261.54 (e)].

 

ROAD CLOSURE DESCRIPTION:

 

The closure applies to National Forest System Road (NFSR) #3089 as show on the attached map. (Attachment A).

PURPOSE:

This closure of NFSR #3809 is necessary because, due to naturally occurring damage to the road, portions of the apparent on-the-ground road footprint have migrated outside of the existing right of way across private property. Members of the public traveling on the road footprint may unknowingly trespass on private property.

IMPLEMENTATION:

This order will be in effect from November 29, 2021, and shall remain in effect until December 31st, 2026, unless rescinded earlier.

 

These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.

 

EXEMPTIONS:

 

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:

 

  1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.

 

  1. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

 

VIOLATION:

 

Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571(b)(6) and 3581(b)(7).
