Webster Pass Seasonal Road Closure

Pursuant to Title 36,Code of Federal Regulations, Section 261.50 (b), the following acts are prohibited on the South Platte Ranger District and Dillon Ranger District as described in this order and as depicted on the map as Exhibit A, within the Pike and Arapaho National Forests, until further notice. The following prohibition applies to a certain portion of the Red Cone Road, Forest Development Road (FDR) 565 on the South Platte Ranger District and a certain portion of the Webster Pass Road, Forest Development Road (FDR) 285 on the Dillon Ranger District. This order applies to the described roads from April 1 to June 30 of each year.

THIS ORDER PROHIBITS:

Using any type of motor vehicle, except snowmobiles and other over the snow machines that are operating on snow. 36 CFR 261.54(a)

On that portion of the Red Cone Road, FDR 565 from its intersection with FDR 121 the Webster Pass Road to its end point at the summit of Webster Pass. Also, on that portion of the Webster Pass Road, FDR 285 from the closure gate to its endpoint at the summit of Webster Pass. See Exhibit A.

Pursuant. to 36 CFR, Section 261.SO(e), the following persons are exempt from this order:

1. Persons with a USDA, Forest Service permit specifically authorizing the otherwise prohibited act or omission.
2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

Violation of these prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for an individual or $10,000 for a legal entity other than an individual, or imprisonment for not more than six (6) months, or both.   Title 16 use, Section 551.
