PUBLIC SAFETY-OCCUPANCY AND USE

 

PROHIBITIONS:

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a) and (b), the following acts are prohibited on all National Forest System (NFS) lands and roads in the Boise National Forest, which are shown on the attached map incorporated into this Order as Exhibit A:

1. Operating a motor vehicle on NFS road in violation of state law relating to the operation of motor vehicles.  36 CFR 261.54(d)

2. Operating a vehicle carelessly, recklessly, or without regard for the rights or safety of other persons or in a manner or at a speed that would endanger or be likely to endanger any person or property. 36 CFR 261.54(f)

3. Parking or leaving a vehicle in violation of posted instructions. 36 CFR 261.58(g)

4. Possessing an alcoholic beverage, as defined by state law, in violation state law. 36 CFR 261.58(bb)

5. Possessing or storing any material containing nails, screws, or other metal hardware, including wood pallets and construction debris, that could be used as firewood. 36 CFR 261.58(cc)

6. Being publicly nude. 36 CFR 261.58(j)

 

EXEMPTIONS:

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

1. Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this Order.

2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force or Forest Service administrative personnel in the performance of an official duty. 

 

Described Area and Roads:

This Order applies to all NFS lands and roads within the Boise National Forest, located in Idaho.

 

PURPOSE:

For public health and safety.

 

IMPLEMENTATION:

1.   This Order will be effective on July15, 2022, and shall remain in effect until July 15, 2027, or until rescinded.

2.  A violation of the above prohibition is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, by imprisonment for not more than six months, or both (see 16 U.S.C. § 551, 18 U.S.C. §§ 3559, 3571, 3581).
