Forest Order 09-19-17-20 Firewood
Protect the Allegheny and do not bring firewood from home to the Allegheny National Forest. Possession of firewood from outside the area of the Allegheny National Forest is prohibited. You could unwittingly spread the emerald ash borer, sirex wood wasp, hemlock woolly adelgid or other firewood borne invasive species.

Forest Order
Under the authority of the Act of Congress dated June 4, 1897, as amended (16 U.S.C. 551), and pursuant to the Secretary of Agriculture's Regulations set forth as 36 CFR Part 261, Subpart B [36 CFR 261.50(a) and (h )], the following acts and/or omissions are prohibited on Allegheny National Forest, Pennsylvania:
- Possessing, storing, or transporting any amount or portion of and species of wood (including firewood) that has originated outside of the counties of Elk, Forest, Warren, and/or McKean within Pennsylvania [36 CFR 261.53 ( e))
THIS RESTRICITION IS NECESSARY TO FOREST RESOURCES. THEY ARE IN ADDITION TO THE GENERAL PROHIBITIONS SET FORTH IN 36 CFR PART 261. THE PROHIBITIONS WILL BE IN EFFECT FROM THE DATE OF THIS ORDER UNTIL SPECIFICALLY WITHDRAWN BY TERMINATION ORDER OF THE FOREST SUPERVISOR.
Pursuant to the provisions of 36 CFR 261.50(e ), the following persons are exempt from this order:
- Persons with a permit granted either by USDA-Animal and Plant Health Inspection Service (APHIS) or the USDA-Forest Service specifically authorizing the act or omission.
- Any federal, state, or local officer, USDA employee, or any other official in performance of an official duty.
Violation of these prohibitions is punishable by a fme of not more than $5000.00 for an individual or $10,000.00 for an organization, or imprisonment for not more than six (6) months, or both (16 U.S.C. 551, l 8 U.S.C. 3559 and 3571).
Justification for Order
The purpose of this order is to restrict the spread of the Emerald Ash Borer and other invasive species. This regulation is to be consistent with other state and federal regulations already in effect.
This order is necessary to protect forest resources and government property from the spread of harmful diseases and/or parasites. It is in addition to all other prohibitions set forth in federal, state, and or local law.
Enforcement Plan
This order will be enforced by law enforcement officers as well as forest protection officers. The primary method of enforcement will be through regular patrols, visitor contacts, signage, and documentation. These patrols may or may not include other law enforcement agencies.
