Occupancy and Use Prohibitions 
TONGASS NATIONAL FOREST 
Ketchikan Misty Fjords Ranger District

Order No. 10-05-52-26-13
 

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a) and (b), the following acts are prohibited on National Forest System lands within the boundaries of the Tongass National Forest, Ketchikan Misty Fjords Ranger District as shown on the attached map and incorporated into this Order as Exhibit A.
 

PROHIBITIONS

1.Going into or being in the Fish Creek Wildlife Observation Site (also known as Hyderbear viewing) south of the river diversion dike (south platform). Shown as Closure Area1 shown on Exhibit A, for the protection of public health and safety. 36 CFR 261.53(e)
2.Parking in the south parking lot (closest to the viewing platform). Shown as Closure Area2 on Exhibit A. 36 CFR 261.58(g)
3.Being on the Titan Trail. Shown as Closure Area 3 on Exhibit A. 36 CFR 261.55(a)
 

EXEMPTIONS
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from the Order:

1.Persons with a Forest Service permit specifically authorizing the otherwise prohibitedact or omission. 36 C.F.R. § 261.50(e)(1).
2.Any Federal, State, or local officer, or member of an organized rescue or fire fightingforce in the performance of an official duty. 36 C.F.R. § 261.50(e)(4).

IMPLEMENTATION

1. This Order is effective August 3, 2026 through October 17, 2026.
2. These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261,Subpart A.
3. A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine ofnot more than $5,000 for individuals and $10,000 for organizations, or by imprisonmentfor not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and3581.
