Pursuant to Title 16 United States Code, Section 551, 36 CFR, Section 261.50(a), the following acts are prohibited on all National Forest System lands within the Boulder and Clear Creek Ranger Districts of the Arapaho and Roosevelt National Forests that are located in Boulder, Clear Creek and Gilpin Counties in the State of Colorado (the “Restricted Area”). The Restricted Area is the James Peak Wilderness Area located in following Township, Range and Sections: T. 1 S., R. 74 W., sec. 21, 22, 26, 27, 28, 32, 33, 34, 35; T. 2 S., R. 74 W., sec. 2, 3, 4, 5, 8, 9, 10, 11, 12, 14, 15, 16, 17, 20, 21, 22, 27, 28, 29, 31, 32, 33; T. 3 S., R. 74 W., sec. 4, 5, 6, 7, 8, 9, 18, 17; T. 3 S., R. 75 W., sec. 1, 11, 12, 13, 14, 15, 23, 24, and is depicted as shown on the attached map hereby incorporated into this ORDER as Exhibit A.
PROHIBITIONS: 1. Building, maintaining, attending, or using a fire or campfire (other than in a selfcontained chemical stove). 36 CFR 261.52(a). 2. Camping within 100 feet of all lakes, streams, and developed trails except for designated campsites and other areas as posted. 36 CFR 261.58(e). 3. Possessing or transporting pets except on a hand-held leash. 36 CFR 261.58(s). 4. Possessing or storing hobbled, tethered or picketed livestock within 100 feet of all lakes, streams or developed trails. 36 CFR 261.58(s). 5. Allowing to graze, any riding or pack animal within 100 feet of any lake, stream or developed trail, except for watering and through travel. 36 CFR 261.57(e) 6. Possessing or transporting unprocessed plant material such as hay, straw, or other unprocessed livestock feed for bedding, feeding, or other uses. 36 CFR 261.58(t). (Additional reference: Region-wide Order No. R2-2005-01) 7. Entering or being in the Wilderness area with groups larger than a combination of 12 persons and/or livestock. 36 CFR 261.58(f). 8. Possessing or using a wagon, cart, bicycle, hang glider, stroller or other motorized or mechanical vehicle. 36 CFR 261.57(h). ORDER No. 10-01-2012-03
EXEMPTIONS: Pursuant to 36 CFR, Sec 261.50(e), the following persons are exempt from the order: 1. Persons with a permit specifically authorizing the otherwise prohibited act or omission. 2. Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty. 3. Hunters are exempt from Prohibition #3, above, while using hunting dogs for legal hunting purposes. 4. Persons with disabilities using assistive devices or aids, in accordance with the Americans with Disabilities Act (PL 101-336). {An assistive device is a piece of equipment used by a person with a disability on a daily basis to help in the accomplishment of one of life's major functions or activities, such as a wheelchair. A wheelchair is defined in the American's with Disabilities Act to be "a device designed solely for use by a mobility-impaired person for locomotion, that is suitable for use in an indoor pedestrian area" [Sec. 507 (c)(2)]. Wheelchair may be motorized or nonmotorized.}
