Occupancy and Use Restrictions Order for the Santa Fe National Forest
The Santa Fe National Forest has the need to limit the stay of the visitors to lessen the opportunity of residency; and to comply with State Law prohibiting the consumption of alcoholic beverages by persons under the age of 21; and to protect general visitors sensitive to public nudity from human disturbance to include families, school groups and visitors visiting National Forest lands.

PROHIBITION
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a) and (b), the following acts are prohibited within the area as described in this Order (the “Restricted Area”) and as depicted on the attached map, hereby incorporated into this Order as Exhibit A, within the Santa Fe National Forest, Sandoval, Rio Arriba, Santa Fe, Los Alamos, San Miguel and Mora Counties within the State of New Mexico. Definitions of terms used in support of this Order are attached and incorporated as Exhibit B.
1. Camping for more than 14 days, whether or not consecutive, within any 45-day period. 36 C.F.R. § 261.58(a).
2. Being publicly nude. 36 C.F.R. § 261.58(j).
3. Possessing a beverage which is defined as an alcoholic beverage by state law. 36 C.F.R. § 261.58(bb).
EXEMPTIONS
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:
1. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
2. Persons 21 years of age or older and not otherwise under any legal restriction against possession of alcoholic beverages are exempt from Prohibition #3, above.
3. Persons with a written Forest Service authorization specifically exempting them from the effect of this Order.
RESTRICTED AREA
All the National Forest System lands, roads and trails located within the boundaries of the Santa Fe National Forest, as shown on Exhibit A.
PURPOSE
The Santa Fe National Forest has the need to limit the stay of the visitors to lessen the opportunity of residency and; to comply with State Law prohibiting the consumption of alcoholic beverages by persons under the age of 21 and; to protect general visitors sensitive to public nudity from human disturbance to include families, school groups and visitors visiting National Forest lands.
IMPLEMENTATION
1. This Order will be effective on June 10, 2021, at 8:00 a.m., and shall remain in effect until Dec 31, 2026 or until rescinded, whichever occurs first.
2. A map identifying the Restricted Area is attached and made part of this Order as Exhibit A.
3. A list of Definitions (Exhibit B) is attached and made part of this Order.
4. Any violation of this prohibition is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six (6) months, or both (see 16 U.S.C. § 551, 18 U.S.C. § 3571(b)(6), 18 U.S.C. § 3581 (b)(7)).
