    Forest Order in regards to prohibitions in Day Use Areas and Rifle Ranges.

Forest Order

Pursuant to Title 16 USC § 551 and Title 36 CFR 261.50 (a) and (b) the following acts are prohibited on the Ouachita National Forest Recreation areas listed below.  

It is prohibited to:  

1.   Be in the area before sunrise or after sundown 36 CFR 261.58(l)

2.   Camp within the designated day use area.  36 CFR 261.58(e)

3.   Park or leave a vehicle in violation of a posted sign.  36 CFR 261.58(g) 

4. Stand or fish from the bridge on Forest Service Road 106 across Little Missouri River.  36 CFR261.58 (b) and 36 CFR 261.58(v) 

5. Be in the area (or posted part of an area) in violation of posted instructions per seasonal closures listed on the Forest’s website, ongoing construction or repair work, flooding conditions or potential for same, and other short-term public safety needs.  36 CFR 261.53(e) 

 

THIS ORDER APPLIES TO THE FOLLOWING BRIDGE AND DAY USE AREAS AS  DEPICTED IN THE MAPS ATTACHED HERETO AND INCORPORATED HEREIN. 

• All shooting ranges     

• Big Brushy 

• Collier Springs  

• Day use-only portions of Bard Springs, Hickory-Nut Mountain, Shady Lake, Cedar Lake, Charlton, and Albert Pike Recreation Areas 

• Dragover 

• Dutch Creek 

• Fulton Branch 

• Hollis CCC 

• Horse Thief Springs 

• Iron Springs 

• Jessieville CCC 

• Kerr Arboretum 

• Knoppers Ford 

• Little Missouri Falls  

• Old Military Road 

• Pipe Springs 

• Rich Mountain  

• River Bluff 

• Rocky Shoals 

• Shirley Creek 

• Talimena Scenic Drive Vistas and Visitor Information Stations 

• Presbyterian Falls 

 

Pursuant to 36 CFR 261.50(e) the following persons are exempt from the above prohibitions: 

1. Persons with a permit specifically authorizing the otherwise prohibited act or omission. 

2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of their official duty. 

3. Persons with a Forest Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order, Form FS-7700-48, specifically exempting them from the effect of this Order. 

4. (e) Persons engaged in any of the following activities which have been authorized in writing by a permit, contract, or agreement: 

  • (1) grazing and livestock use, 36 C.F.R. Part 222 (§§ 222.1 – 222.76);
  • (2) timber and special forest products use, 36 C.F.R. Part 233 (§§ 223.1 – 223.305); or
  • (3) mineral use, 36 C.F.R. Part 228 (36 C.F.R. §§ 228.1 – 228.116). 

5. Owners or lessees of land, to the extent necessary to access their land. 6. Residents, to the extent necessary to access their residences.  

 

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.
