Occupancy and Use Restrictions in the Peavine and Dog Valley area of H-T National Forest
A. PROHIBITIONS
Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited in the area, as described in this order, in the Carson City Ranger District, Humboldt-Toiyabe National Forest beginning October 22nd, 2021 at 17:00 P.M. and ending October 21st, 2026 unless rescinded earlier.
- Being in the area after 10pm and before 6am. [36 CFR 261.58(l)]
- Camping [36 CFR 261.58 (e)].
- Building, maintaining, attending or using a fire, campfire, or stove fire, subject to the Exemptions below.[36 CFR 261.52(a)].
B. EXEMPTIONS
Pursuant to 36 CFR 261.50(e), the following persons are exempt from specified Prohibitions of this Order.
- Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.
- Persons using pressurized liquid or gas devices (stoves, grills, or lanterns) with shut-off valves in an area at least three feet from any flammable materials are exempt from Prohibition #1
- Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty
C. AREA DESCRIBED
National Forest System lands on the Humboldt-Toiyabe National Forest Carson Ranger District as shown on Exhibit A, Map. ½ mile radius for the following established staging areas and or forest boundaries:
West Keystone staging area
East Keystone staging area
Las Brisas staging area
Hoge Rd staging area
Raleigh Heights staging area
Horizon Hills staging area
Peavine Peak Rd forest boundary
Red Metal staging area
Dog valley Rd forest boundary Verdi side
Dog Valley Rd forest boundary Bordertown side
Dog Valley Summit One staging area
D. PURPOSE
The purpose of this order is for Public Health and Safety and the Protection of Resources.
E. IMPLEMENTATION
- This Special Order implementing Area Closure Restrictions is effective at 17:00P.M. On October 22nd, 2021 and shall remain in effect until September 30th, 2026.
- Exhibit A, Map, Exhibit B, Definitions are attached and incorporated into this ORDER.
Violation of these prohibitions is punishable as a class B misdemeanor, by a fine of not more than $5000.00 for an individual or $10,000.00 for an organization and/or imprisonment of not more than 6 months [Title 16 USC 551, 18 USC 3571(b (6), Title 18 USC 3581 (b)(7)].

EXHIBIT B DEFINITIONS
Occupancy and Use Restrictions
AREA: Means a discrete, specifically delineated space that is smaller, and in most cases much smaller, than a Ranger District.
CAMPING: means the temporary use of National Forest System lands for the purpose of overnight occupancy without a permanently-fixed structure.
(This includes Developed Recreation Sites; Campgrounds, and any Dispersed Camping)
CAMPFIRE: A fire, not within any building, mobile home, or living accommodation mounted on a motor vehicle, which is used for cooking, branding, personal warmth, lighting, ceremonial, or esthetic purposes.
STOVE FIRE: A campfire built inside an enclosed stove or grill, a portable brazier, or a pressurized liquid or gas stove including a space heating device.
NATIONAL FOREST SYSTEM: includes all national forest lands, and waters reserved or withdrawn form the public domain of the United States, national forest lands and waters acquired through purchase, exchange, donation, or other means, national grasslands and land utilization projects and waters administered under title III of the Bankhead-Jones Farm Tenant ACT (50 Stat. 525, 7 U.S.C. 1010-1012), and other lands, waters, or interests therein acquired under the Wild and Scenic River Act (16 U.S.C. 1272-1287) or National Trails Systems Act (16 U.S.C. 1241-1249).
