OCCUPANCY AND USE
PROHIBITIONS:
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a) and (b), the following acts are prohibited on National Forest System (NFS) designated as the Frank Church-River of No Return Wilderness ("Restricted Area") and all NFS trails within the Restricted Area ("Restricted Trails"), which are described further below and depicted on the attached map incorporated into this Order as Exhibit A:
- Using the Restricted Area with a group of more than 20 persons or more than 20 saddle, pack, or draft animals per individual or group. 36 CFR 261.58(f)
- Possessing or using a saddle, pack, or draft animal, unless ridden or led in single file, on any Restricted Trail. 36 CFR 261.55(c)
- Possessing livestock salt that is not in block form and contained off the soil 36 CFR 261.57(b)
- Camping within the same five-mile radius for more than 14 days within any 30 consecutive day period. 36 CFR 261.58(a)
- Returning to camp in any part of the five-mile radius within 45 days after having camped in the same location or any number of locations within the same 5-mile radius for 14 days in a 30-day period. 36 CFR 261.58 (a)
- Storing equipment, personal property, or supplies within the same five-mile radius for more than 14 days within any 30 consecutive day period. 36 CFR 261.57(1)
- Disposing of any debris or garbage, including excess livestock salt, unless it is reduced to ashes. 36 CFR 261.57(g)
- Shortcutting a switchback on any Restricted 36 CFR 261.55(e)
EXEMPTIONS:
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:
- Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this
- Any Federal, State, or local officer, or member of an organized rescue or fire fighting force or Forest Service administrative personnel in the performance of an official
RESTRICTED AREA AND RESTRICTED TRAILS:
The Restricted Area includes all NFS lands and waters within the boundaries of the Frank Church-River of No Return Wilderness and the proclaimed and administrative boundaries of the Bitterroot, Nez Perce, Payette, and Salmon-Challis National Forests. The Restricted Trails are all NFS trails within the Restricted Area.
The Restricted Area and Restricted Trails exclude the NFS lands, waters, and trails within the boundaries of the Salmon and Middle Fork of the Salmon Wild and Scenic River Corridors.
PURPOSE:
The purpose of this Order is to implement visitor use requirements for activities within the Restricted Area and on the Restricted Trails, as required by the Frank Church-River of No Return Wilderness Area Management Plan (November 2003).
IMPLEMENTATION:
- This Order will be effective on February 8, 2022, at 12:01 AM and shall remain in effect until February 8, 2027, or until rescinded, whichever event occurs first.
- Any violation of the prohibitions in this Order is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months (see 16 U.S.C. § 551, 18 S.C. §§ 3559, 3571, 3581).
