Northern and Intermountain Regions Salmon Wild and Scenic River: Occupancy and Use
This order enacts visitor use restrictions for activities within the 80-mile-long wild segment of the Salmon Wild & Scenic River corridor, including a one-quarter mile buffer from the river, as required by the Frank Church-River of No Return Wilderness Area Management Plan (November 2003).

OCCUPANCY AND USE
PROHIBITIONS
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following acts are prohibited on the National Forest System (NFS) lands and waters in the wild segment of the Salmon Wild & Scenic River Corridor within the Bitterroot, Nez Perce, Payette, and Salmon-Challis National Forests, which is described further below and depicted on the attached map incorporated into this Order as Exhibit A ("Restricted Area"):
- Entering or being in or on the Restricted Area with any motorized or non-motorized device that can be used for transportation in or on a body of water, including motorboats, powerboats, jetboats, jetskis, rafts, air mattresses, inner tubes, kayaks, or 36 CFR 261.58 (n), (w), (z)
- Being publicly 36CFR261.58 U)
- Disposing any debris, garbage, ashes, or other waste, except into a container that is removed from the NFS lands when the individual or group responsible for creating that waste leaves the Restricted Area. 36 CFR 261.58 (z)
- Disposing any solid human waste, except into a leak-proof portable toilet or other self-contained receptacle that is removed from NFS lands when the individual or group responsible for creating that waste leaves the Restricted 36 CFR 261.58 (z)
- Building, maintaining, attending, or using any fire or campfire, except within a stove, brazier, or fire pan that prevents escape of charcoal or ash onto the 36 CFR 261.52 (a)
- Camping within the Restricted Area for more than 14 consecutive 36CFR261.58(a)
- Landing of aircraft, including drones or unmanned aerial devices, or dropping or picking up any material, supplies, or person by means of an aircraft, including a 36 CFR 261.58 (y)
- Camping within 250 yards of Barth Hot Springs (NE ¼ of SE ¼, Section 18, Township 25 North, Range 12 West, Boise Meridian). 36 CFR 58 (e)
- Using the Restricted Area with a group of more than 30 36CFR261.58(f)
- Possessing more than 20 saddle, pack, or draft animals per individual or 36CFR261.58(z)
EXEMPTIONS:
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order or specific prohibitions as set forth below:
- Persons with a Forest Service special use authorization or other authorization specifically exempting them from the effect of this Order.
- Any Federal, State, or local officer, or member of an organized rescue or fire fighting force or Forest Service administrative personnel in the performance of an official
- Persons landing aircraft, or dropping off or picking up any materials, supplies, or persons by means of an aircraft, including a helicopter, at Wilson Bar are exempt from Prohibition
RESTRICTED AREA:
The 80-mile long wild segment of the Salmon Wild & Scenic River corridor begins at Wheat Creek, Salmon-Challis National Forest in Section I, Township 23 North, Range 14 East, Boise Meridian, and ends at Long Tom Bar, Payette National Forest in Section 32, Township 24 North, Range 5 East, Meridian. The Restricted Area includes the ¼ mile in width from the center of the river on either side of the river for the length of this wild segment.
The Restricted Area is within the proclaimed and administrative boundary of the Bitterroot, Nez Perce, Payette, and Salmon-Challis National Forests and the Frank Church-River of No Return Wilderness.
PURPOSE:
This purpose of this Order is to implement visitor use requirements for activities within the Restricted Area, as required by the Frank Church-River of No Return Wilderness Area Management Plan (November 2003).
IMPLEMENTATION:
- This Order will be effective on May 28, 2021 at 12:01 AM and shall remain in effect until May 28, 2026, or until rescinded, whichever event occurs first.
- A violation of the prohibitions in this Order is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six (6) months (see 16 U.S.C. § 551, 18 U.S.C. §§ 3559, 3571, 3581).
- This Order supersedes, rescinds, and replaces any previous orders prohibiting the same acts covered by this Order.
