Forest Order

PROHIBITIONS

Pursuant to Title 36 CFR 261.50(a) the following act is prohibited on the streams as described in this order within the administrative and proclaimed boundaries of the Krassel and McCall Ranger Districts, Payette National Forest, when signed by the Forest Supervisor and shall remain in effect until further notice.

  1. Entering or being on the South Fork of the Salmon River (below the confluence with the East Fork of the South Fork Salmon River) or Big Creek with float boating equipment.     36 CFR 261.SS(k)

EXEMPTIONS

Pursuant to 36 CFR 261.50 (e) the following persons are exempt from this order:

  1. Persons with a special use authorization or other Forest Service authorization, such as a Visitor Permit and float boating tag, specifically exempting them from the effect of this Order.
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  3. Federal or State administrative personnel in the performance of an official duty.

STREAMS DESCRIBED

South Fork of the Salmon River, from the point of beginning at the confluence of the South Fork of the Salmon River and the East Fork of the South Fork of the Salmon River in Sec ion 3, Township 19 North, Range 6 East, then northeasterly, downstream, on the South Fork of the Salmon River approximately 34 miles to the confluence of the South Fork of the Salmon River and the Salmon River in Section 32, Township 24 North, Range 8 East, Boise Meridian, Valley and Idaho Counties, Idaho and within the Krassel and McCall Ranger Districts, Payette National Forest.

Big Creek (2 tributary of the Middle Fork of the Salmon River), from the point of beginning at the confluence of Big Creek and Smith Creek in Section 13, Township 21 North, Range 9 East, then easterly, downstream, on Big Creek approximately 31 miles to the confluence of Big Creek and the Middle Fork of the Salmon River in Section 10, Township 20 N01th, Range 14 East, Boise Meridian, Valley County, Idaho and within the Krassel District, Payette National Forest.

 

PURPOSE

The purpose of the Order is to implement permit requirements for float boating on the South Fork of the Salmon River (a tributary to the Salmon River) and Big Creek (a tributary to the Middle Fork of the Salmon River) as required by the Frank Church River of No Return Wilderness Area Management Plan (November, 2003). The requirement to have a Visitor Permit and float boating Tag while float boating on the above described streams is in effect during all periods open to boating. Big Creek is closed to the use of float boat equipment annually from April 1 through May 31 and August through September 30 pursuant to Payette National Forest Supervisor's Order #04-12-318 dated April 17, 2001.

 

DEFINITIONS

Float boating equipment: Any device by which any persons(s) may be transported in or upon a body of water; such as, but not limited to rafts, boats, air mattresses, inner tubes, hard shell kayaks, inflatable kayaks, canoes, etc.

 

IMPLEMENTATION

  1. This Special Order implementing float boating permit requirements upon designated reaches of the South Fork of the Salmon River and Big Creek, as described above, is in effect during any open boating period.
  2. A map identifying the described streams is attached and made part of this Order.
  3. Violation of the above prohibitions is punishable by a fine of not more than $5,000.00 for an individual, or $10,000.00 for an organization, and/or imprisonment for not more than six (6) months. [Title 16 USC 551, Title 18 USC 3571(b)(6), Title 18 USC 3581 (b)(7)].
