Forest Order

PROHIBITIONS
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a) the following are prohibited on the National Forest System (NFS) lands in the Frank Church-River of No Return Wilderness, in the Krassel Ranger District, Payette National Forest, described below and shown on the attached maps incorporated into this Order as Exhibits A through F (the “Described Area):
1. Camping, except at designated sites. 36 C.F.R. § 261.58 (e)

2. Camping for more than three nights within any 30-day period at each lake. 36 C.F.R. § 261.58(a)

3. Camping by more than eight persons per designated site. 36 C.F.R. § 261.58( f)

4. Holding or grazing of pack and saddle stock except at a designated site as posted. 36C.F.R. § 261.58(aa).

5. Grazing or camping with stock for more than three nights within a 30-day period. 36C.F.R. § 261.57(e) and/or 36 C.F.R. § 261.58(a).

6. For an individual or group to possess more than 12 head of stock when camping. 36 C.F.R. § 261.57(b) or 36 C.F.R. § 261.58(f)


EXEMPTIONS
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:
1. Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails or Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (2).
2. Any Federal, State, or Local Officer, or member of an organized rescue orfirefighting resource in the performance of an official duty.
3. Forest Service administrative personnel in the performance of an official duty.


DESCRIBED AREA
The Described Area is within Valley and Idaho Counties, Idaho, Boise Meridian. It includes all NFS lands described below:

Prohibitions 1-4: Within 200 feet horizontal distance from the high-water mark of the lakes described below and identified in Exhibits A, B, C, E, F:
-Lick Lake (Section 13, Township 20 North, Range 9 East)
-Bear Lakes (Section 30, Township 20 North, Range 10 East; Section 25,Township 20 North, Range 9 East)
-Sheepeater Lake (Sections 27 & 34, Township 24 North, Range 9 East)
-Black Lake (Sections 14 & 23, Township 23 North, Range 13 East)

Prohibitions 5-6: In or within 200 feet of the lakes described below and identified in Exhibits A, B, D, F:
-Crescent Meadows (Section 6, Township 21 North, Range 12East)
-Fish Lake Meadow (Section 26, Township 24 North, Range 9East)
-Cougar Basin (Sections 19 & 30, Township 20 North, Range 10 East)

 

PURPOSE

The purpose of this Order is to protect fragile, high elevation, water-based natural resources within the Frank Church-River of No Return Wilderness from stock and user impacts.


IMPLEMENTATION
1. This Order shall be in effect from June 10, 2025, at 12:00 p.m. through June 10,2030, at 11:59 p.m., unless rescinded.
2. A map identifying the Described Areas is attached and made part of this Order asExhibits A-F. For a digital version of this Order and Exhibits A-F, go tohttps://www.fs.usda.gov/r04/payette/alerts.
3. Unless otherwise expressly defined in this Order, the terms used in this Orderare defined by the regulations of the Secretary of Agriculture, 36 C.F.R. ChapterII, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions.

4. A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and 3581.

6. This Order supersedes Orders #0402-198 and #0412-199 prohibiting the same or similar acts in the same Described Area.
