Forest Order

Under authority of the Act of Congress of June 4, 1897, as amended (16 USC 551) and pursuant to the Secretary of Agriculture’s Regulations set forth at 36 CFR Part 261, Subpart B (36 CFR 261.50 (a) and (b)). These restrictions are in addition to those enumerated in Code of Federal Regulations Title 36, Part 261, Subpart A, and become effective when signed and will remain in effect until rescinded.

Prohibitions:

The following acts or omissions are prohibited on the Midewin National Tallgrass Prairie, and are necessary for public health, safety, and to protect National Forest property.

  1. Operating or using any internal or external combustion engine without a spark arresting device properly installed, maintained and in effective working order meeting either: Department of Agriculture, Forest Service Standard 5100.1a: or Appropriate Society of Automotive Engineers (SAE) recommended practice J335(b) and J350(a). (36 CFR 261.52j)
  2. Using any type of motor vehicle on National Forest System road that has been signed to prohibit such use. (36 CFR 261.54a)
  3. Using a road for commercial hauling without a permit or other written authorization. (36 CFR 261.54c)
  4. Operating a vehicle in violation of the speed, load, weight, height, length, and width limitations. (36 CFR 261.54d)
  5. Operating a vehicle in violation of the speed, load, weight, height, length, width, other limitations or possessing or operating a motorized vehicle on any National Forest System road in violation of Illinois State law. (36 CFR 261.54d)
  6. Being on the road, those roads/railroads and former roads/railroads having a physical barrier such as a gate, berm of earth, trench, post, logs, rocks, natural vegetation, former/grown-up road, or other device or impedes passage or not designated, posted, or signed as open for all types of uses except foot traffic. (36 CFR 261.54e)
  7. Operating a vehicle carelessly, recklessly, or without regard for the rights or safety of other persons or in a manner or at a speed that would endanger or be likely to endanger any person or property. (36 CFR 261.54f)
  8. Being on a trail when posted closed. (36 CFR 261.55a)
  9. The use of any type of vehicle or mode of transport including bicycles, mountain bikes, horses or pack animals off National Forest System trails. (36 CFR 2615.55c)
  10. To possess or use a vehicle, motorized equipment (including bicycles, mountain bikes, horses, or pack animals) off National Forest System roads. (36 CFR 261.56) Exception: Deer carts during deer season.

This order supersedes and rescinds Forest Order 5300-15-04-02 signed June 4, 2004.

Exemptions:

Pursuant to Title 36 CFR 261.50 (e), the following persons are exempt from this order:

  1. Persons with a permit from the authorized Forest Service Officer specifically authorizing an otherwise prohibited act or omission.
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force working in the performance of an official duty.

Enforcement:

Violations of these Prohibitions are punishable by a fine of not more than $5,000 for an individual and $10,000 for an organization or imprisonment for not more than six (6) months, or both. [16 USC § 551, 18 USC §§ 3559 and 3571]
