PROHIBITIONS

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following acts are prohibited within the area described in this Order (the “Restricted Area”) and as depicted on the attached map, hereby incorporated into this Order as Exhibit A, within the Pemigewasset Ranger District, White Mountain National Forest, Grafton County, NH. 

 It is prohibited to go into or be upon the area when it is posted as closed to public use for the protection of public health and safety due to hazardous bear activity. (36 C.F.R. § 261.53(e)).

EXEMPTIONS

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

Persons with a written Forest Service authorization specifically exempting them from the effect of this Order.

Any Federal, State, or Local Officer, or member of an organized rescue or firefighting resource in the performance of an official duty.

RESTRICTED AREA

the attachment labeled Exhibit A. Camping with .25 miles of the restricted area is prohibited under existing White Mountain National Forest Supervisor Orders.

PURPOSE

Franconia Brook Campsite is located on the East Side Trail on the Pemigewasset Ranger District. Due to escalating behavior of a food habituated black bear (Ursus americanus) in the area which has damaged several tents in recent days, this restriction is needed to protect public health and safety until the habituated bear is judged to no longer pose a safety risk.

Posting of the Order as required in 36 CFR 261.50 will provide notification to National Forest visitors that activities are restricted in the area shown on attached map. An enforcement plan describes how the public will be informed of the prohibitions, how it will be posted, and planned enforcement strategies.

IMPLEMENTATION

This Order will be effective on August , 2025, and shall remain in effect until rescinded. A map identifying the Restricted Area is attached and made part of this Order as Exhibit

A. Any violation of this prohibition is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for

not more than six (6) months, or both (see 16 U.S.C. § 551, 18 U.S.C. § 3571(b)(6), 18 U.S.C. § 3581 (b)(7)).
