PROHIBITIONS
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a), the following is prohibited on the National Forest System (NFS) lands in the Globe Ranger District, Tonto National Forest, described below and shown on the attached map incorporated into this Order as Exhibit A (the “Described Area”):
- Possession or use of a motor vehicle off National Forest System roads. 36 C.F.R. § 261.56
EXEMPTIONS
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:
- Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (2).
- Any Federal, State, or Local Officer, or member of an organized rescue or firefighting resource in the performance of an official duty.
DESCRIBED AREA/ROADS/TRAILS
The Described Area is within Township 2 South Range 12 East Section 8. It consists of all National Forest System lands within the Boundary starting at the intersection Motorized Trail (MT) 3154 and Administrative MT-2403, then following southeast along MT-3154 approximately 0.25 miles to the intersection with Legends of Superior Trail #221, then following south and east along Legends of Superior Trail #221 and around the Parking Area approximately 0.1 miles to the intersection with the Non-Forest Service Ownership boundary at Reference Point 33° 16.575' N x -111° 08.219' W, then following south and east along the Non-Forest Service Ownership approximately 0.1 miles to the intersection with the cliff edge at Reference Point 33° 16.518' N x -111° 08.196', then following generally southwest along the cliff edge approximately 0.25 miles to the intersection with Administrative MT-2403 at Reference Point 33° 16.424' N x -111° 08.324', then following north along Administrative MT-2403 approximately 0.35 miles back to the starting point at the intersection with MT-3154.
Note:
Motorized Trails MT-3154 and MT-2403 along the Described Area boundary and Trail #221 "Legends of Superior Trail" remain open.
PURPOSE
The purpose of this Order is to protect and promote sustainability of sensitive riparian areas and other Forest resources and values while continuing to organize and manage recreation OHV use.
IMPLEMENTATION
- This Order shall be in effect from September 5, 2024 at 6:00 am to September 4, 2029 at 10:00 pm, unless rescinded.
- A map identifying the Described Area is attached and made part of this Order as Exhibit A. For a digital version of this Order and Exhibit A, go to https://www.fs.usda.gov/r03/tonto/alerts.
- Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions.
- A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and 3581.
