    Dogs mush be leashed within the boundaries of the Forest Service System Lands in the Jacks Valley Wildlife Management area south and west of Jacks Valley Road, east of Highway 395 at Forest Boundary and to the south at the Forest Boundary within the Management area.

    The prohibited acts defined in this order were identified because of the need to avoid contact from domestic dogs not under physical restraint that may harass and or harm livestock.

Dog Leash Requirements Order

A. PROHIBITIONS

Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited on

The roads, trails and area as described in this order, on the Carson Ranger District, Humboldt-Toiyabe National Forest until November 30th 2025 unless rescinded earlier.

  1. Possessing a dog(s) not under physical restraint of a leash that is no longer than 6 feet in length or confined in a vehicle.
  2. [36 CFR 261.58(s)]

B. EXEMPTIONS

Pursuant to 36 CFR 261.S0(e), the following is exempt from this order.

  1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  3. Persons with disabilities that require the use of a certified service dog
  4. AREA DESCRIBED

The following National Forest System Lands and Trails on the Humboldt-Toiyabe National Forest as shown on Exhibit A map. The area described is as follows within the boundaries of the Forest Service System Lands in the Jacks Valley Wildlife Management area south and west of Jacks Valley Road, east of Highway 395 at Forest Boundary and to the south at the Forest Boundary within the Management area.

C. PURPOSE

The prohibited acts defined in this order were identified because of the need to avoid contact from domestic dogs not under physical restraint that may harass and or harm livestock.

D. IMPLEMENTATION

1. This Special Order is effective at 17:00 P.M. October 6, 2020. The order will be in effect annually from October 1st through November 30th of each year, and shall remain in effect until November 30, 2025.

E. DEFINITIONS

AREA: means a discrete, specifically delineated space that is smaller, and in most cases much smaller, than a Ranger District.

VEHICLE: means any device in, upon, or by which any person or property is or may be transported, including any frame, chassis, or body of any motor vehicle, except devices used exclusively upon stationary rails or tracks.

FOREST ROAD OR TRAIL: means a road or trail wholly or partly within or adjacent to and serving the National Forest System that the Forest Service determines is necessary for the protection, administration, and utilization of the National Forest System and the use and development of its resources.

Violation of these prohibitions is punishable as a class B misdemeanor, by a fine of not more than $5000.00 for an individual or $10,000.00 for an organization and/or imprisonment of not more than 6 months [Title 16 USC 551, Title 18 USC 3571(b)(6), Title 18 USC 3 581 (b)(7)].
