    All areas, roads, and trails within the boundaries of the U.S. Marine Corps Mountain Warfare Training Center base camp, located off State Highway 108 near Sonora Pass, are subject to this closure order. This includes a portion of the authorized intensive use area containing improvements permitted for the U.S. Marine Corps Mountain Warfare Training. However, the closure order specifically excludes Silver Creek and Silver Creek Road (Forest Service Road 058), including the gate guard building, barriers on Silver Creek Road, and the pedestrian bridge over Silver Creek

US Marine Corps Mountain Warfare Training Center Intensive Use Area Closure Order

 

A. PROHIBITIONS

Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited on the area, roads, and trails as described in this order, in the Bridgeport Ranger District, Humboldt-Toiyabe National Forest beginning September 13, 2010 at 12:01 A.M. and continuing until further notice.

  1. It is prohibited to go into or be upon any area which is closed for the protection of:

          a. Public Health or Safety. [36 CFR 261.53(e)]

          b. Property. [36 CFR 261.53(f)

  2. Being on the road. [36 CRF 261.54(e)]
  3. Being on a trail. [36 CFR 261.55(a)]

B. EXEMPTIONS

Pursuant to 36 CFR 261.50(e), each of the following is exempt from this order.

  1. Persons with a permit specifically exempting them from the effect of this Order.                                                                                                                
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  3. Person engaged in a business, trade or occupation affiliated with the US Marine Corps Mountain Warfare Training Center.
  4. Silver Creek and the Silver Creek Road (FS058), including the gate guard building and barriers on Silver Creek road, and the pedestrian bridge over Silver Creek.

C.  AREA DESCRIBED

All areas, roads and trails within the boundaries of the US Marine Corps Mountain Warfare Training Center base camp located off State Highway 108 near Sonora Pass pertaining to a portion of the authorized intensive use area containing improvements permitted to the US Marine Corps Mountain Warfare Training, excluding Silver Creek and Silver Creek Road (FS 058). The closure order area does not include Silver Creek, Silver Creek Road, or any improvements thereon, to include the Gate Guard Building and barriers on Silver Creek Road, and the pedestrian bridge over Silver Creek, on the Bridgeport Ranger District, Humboldt-Toiyabe National Forest as show on Exhibit A, Map.

D. PURPOSE

The above prohibition is authorized to allow the permittee to provide security for permittee owned buildings and improvements in a portion of the authorized use area containing improvements and to facilitate public safety.

E. IMPLEMENTATION

  1. This Special Order implementing Area Closure Restrictions is effective at 12:01 A.M. on September 13, 2010, and shall remain in effect until rescinded.
  2. Exhibit A, Map and Exhibit B, Definitions are attached and incorporated into this ORDER.

Violation of these prohibitions is punishable as a class B misdemeanor, by a fine of not more than $5000.00 for an individual or $10,000.00 for an organization and/or imprisonment of not more than 6 months [Title 16 USC 551, 18 USC 3571(b) (6), Title 18 USC 3581 (b) (7)].
