SPECIAL ORDER OF FOREST SUPERVISOR

UINTA-WASATCH-CACHE NATIONAL FOREST

OGDEN RANGER DISTRICT

 

CAUSEY RESERVOIR 

 

PROHIBITIONS:

Pursuant to Title 36 CFR 261.50 (a) and (b) the following acts are prohibited on National Forest System lands and water known as Causey Reservoir as described in this order. The lands and water known as Causey Reservoir affected by this order are located all within the Ogden Ranger District, Uinta-Wasatch-Cache National Forest.  This Order is in effect from June 30, 2022 through June 23, 2027, as described below and shown on map   

  1. Possessing a beverage which is defined as an alcoholic beverage by Utah State Law (32B-1-102(3)) in or upon Causey Reservoir. [36 CFR 261.58(bb)].
  2. Operating a boat/watercraft/vessel in violation of Utah State Law, to wit; Title 73-18, 18a and 18b on Causey Reservoir. [36 CFR 261.58(k)]
  3. Operating any boat/watercraft/vessel in excess of a wakeless and or trolling speed. [36 CFR 261.58(q)]
  4. Possessing, discharging, or using any kind of firework or other pyrotechnic device on National Forest system Lands at Causey Reservoir. [36 CFR 261.52(f)]

EXEMPTIONS: 

Pursuant to 36 CFR 261.50 (e) the following persons are exempt from this Order:

  1. Persons with a permit specifically exempting them from the effect of this order.
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  3. Federal or State administrative personnel in the performance of an official duty.

 

AREA DESCRIBED:

All National Forest System lands around Causey Reservoir and Causey Reservoir located in Township 6 North, Range 3 East, Sections 1, 2 and 3; Township 7 North, Range 3 East, Sections 34, 35, 36, 26 and 27 all within the Salt Lake Base Meridian and as shown on attached map. 

 

PURPOSE: 

To be consistent with Weber County alcohol ordinance 2017-20 and Utah State Boating and Safety regulations in order to show cohesive enforcement on and around Causey Reservoir.

 

IMPLEMENTATION:

  1. This Order will be in effect when signed on, June 30, 2022 and will remain in effect until June 30, 2027, or until rescinded.
  2. A map identifying the closure area is attached hereto and made part of this Order.
  3. Any violation of this prohibition is punishable by a fine of not more than $5,000.00 for an individual or $10,000.00 for an organization, and/or imprisonment for not more than six (6) months. [Title 16 USC 551, Title 18 USC 3571(b) (6), Title 18 USC 3581 (b) (7)].
  4. Further information regarding this Order may be obtained at the Ogden Ranger District, 801-625-5112 or the Uinta-Wasatch-Cache National Forest Supervisor’s office, 801-999-2103.
  5. This order supersedes any previous Order prohibiting the same, or similar acts in the areas (and/or roads or trails) covered by this Order and descripted above.

32B-1-102.  Definitions. 
As used in this title:
 

(3) "Alcoholic beverage" means the following: 

      (a) beer; or 

      (b) liquor. 

(4) (a) "Alcoholic product" means a product that: 

              (i) contains at least .5% of alcohol by volume; and 

              (ii) is obtained by fermentation, infusion, decoction, brewing, distillation, or other process that uses liquid or combinations of liquids, whether drinkable or not, to create al                       cohol in an amount equal to or greater than .5% of alcohol by volume. 

      (b) "Alcoholic product" includes an alcoholic beverage. 

      (c) "Alcoholic product" does not include any of the following common items that otherwise come within the definition of an alcoholic product: 

              (i) except as provided in Subsection (4)

      (d), an extract;

             (ii) vinegar; 

            (iii) preserved nonintoxicating cider; 

            (iv) essence; 

            (v) tincture; 

            (vi) food preparation; or 

           (vii) an over-the-counter medicine. 

     (d) "Alcoholic product" includes an extract containing alcohol obtained by distillation when it is used as a flavoring in the manufacturing of an alcoholic product.
