    This Order prohibits unloading, storing, or using any straw, hay, grain, seed, or other forage or mulch products that are not state-certified weed free on the National Forest System lands, roads or trails in any Closure Area as specific in the Order. Some examples of these include hay bales, hay cubes, straw and straw bales, and grain.

Forest Order

REGIONAL ORDER: Restrictions on Use of Forage and Mulch Products

Pursuant to 16 USC § 551 and 36 CFR § 261.50(a) and (b), the following acts are prohibited upon all lands, roads and trails within the National Forests, National Scenic Areas, National Monuments and National Grasslands administered by the Pacific Northwest Region (Region 6) within the states of Oregon, Washington, California, and Idaho as described below. This Order is effective from [7/1/2021] through [7/1/2026] unless rescinded earlier.

  • Colville National Forest
  • Umatilla National Forest
  • Deschutes National Forest
  • Umpqua National Forest
  • Fremont-Winema National Forest
  • Wallow-Whitman National Forest
  • Gifford Pinchot National Forest
  • Willamette National Forest
  • Malheur National Forest
  • Crooked River National Grassland
  • Mt Baker-Snoqualmie National Forest
  • Hells Canyon National Recreation Area
  • Mt Hood National Forest
  • Oregon Dunes National Recreation Area
  • Ochoco National Forest
  • Cascade Head Scenic Research Area
  • Okanogan-Wenatchee National Forest
  • Columbia River Gorge National Scenic Area
  • Olympic National Forest
  • Mount St Helens National Volcanic Monument
  • Rogue River-Siskiyou National Forest
  • Newberry National Volcanic Monument
  • Siuslaw National Forest

PROHIBITION:

1. Possessing, storing or transporting any part of a tree or other plant, as specified in the order. [36 CFR § 261.58(t)] This order prohibits unloading, storing, or using any straw, hay, grain, seed, or other forage or mulch products that are not state-certified weed free on the National Forest System lands, roads or trails in any Closure Area. Some examples of these include hay bales, hay cubes, straw and straw bales, and grain.

EXEMPTIONS:

Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this order: 

1. Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order.

2. Any Federal, State, or local officer, or member of any organized rescue or firefighting force in the performance of an official duty.

3. Persons transporting forage or mulch products across the Closure Area without unloading or using the products on NFS lands, roads or trails. 36 C.F.R. § 261.50(e)(6).

4. Persons possessing or storing commercially processed feed (feed pellets or steamed, rolled grains) or persons possessing state certified weed free hay, forage or mulch products packaged as bales, containers or sacks when also marked using official tags, twine or other identification as required by the product’s State of origin, or in possession of the original and current State documentation certifying the hay, forage or mulch products meet or exceed the North American Invasive Species Management Association (NAISMA) or comparable certification standard.
 

These prohibitions are in addition to general prohibitions pursuant to 36 CFR Part 261, Subpart A. This order does not rescind or replace any other Forest Order or special restrictions pertaining to the described lands. Violations of these prohibitions are punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six (6) months, or both. 16 USC § 551; 18 USC §§ 3551, 3559, 3571, and 3581.
