Forest Order 09-05-20-01: Conditions of Use Forest-wide
Occupancy and prohibitions for camping in developed areas, forest quiet hours, parking, trash removal, glass beverage and food containers, alcohol use (must be over 21), cannabis, spark arrestors, and a few other items.

Pursuant to 16 USC 551 and 36 CFR 261.50(a), the following acts are prohibited on all Forest Service lands on the Mark Twain National Forest. This Order is effective upon the date of signature until rescinded and this order rescinds and supersedes Order#R9-05-17-09, signed on September 18th, 2017.
1. Camping in excess of 14 days in any 30-day period. After the 14 days has been reached, no camping is allowed anywhere in the Mark Twain National Forest until the end of the 30-day period. (36 CFR 261.58a)
2. To establish, maintain, or occupy any camp or camping equipment present in excess of 14 days in any 30-day period. Once the camp has reached 14 days within a 30-day period, it must be removed from the Mark Twain National Forest and cannot be reestablished until the end of the 30-day period. (36 CFR 261.58a)
3. Entering or using a developed recreation site or portion, thereof, when that site or facility is posted closed. (36 CFR 261.58b)
4. It is prohibited to enter or to remain in a campground between the hours of 10:00 PM and 6:00 AM, except for persons who are occupying such campgrounds. (36 CFR 261.58c)
5. To use a single developed campsite by more than eight (8) users or a double developed campsite by more than sixteen (16) users. (36 CFR 26158f)
6. Possessing, parking or leaving more than two (2) motor vehicles in a single developed campsite or four (4) motor vehicles in a double developed campsite, except motorcycles and bicycles. (36 CFR 261.58i)
7. It is prohibited for any person under the age of twenty-one (21) years to have in their possession, a beverage which is defined as an intoxicating liquor by Missouri state law (RSMO 311.020). (36 CFR 261.58bb)
8. Possessing, storing, or transporting any part of a tree or plant, as specified. For the purpose of this order, it is prohibited to possess cannabis plant(s) or any substance derived from the manufacture of cannabis, except those cannabis plants and derivatives defined as hemp under the 2018 Farm Bill. 9. Possessing or storing any glass beverage or glass food container within any canoe, kayak, raft, or inner tube while upon any navigable waterway as defined under RSMO 306.325(1). (36 CFR 261.58cc)
10. Failing to carry and affix to any canoe, kayak, raft or inner tube, a container or bag suitable for containing refuse, waste, and trash material and which is capable of being securely closed while upon any navigable waterway as defined under RSMO 306.325 (1). (36 CFR 261.58cc)
11. Possessing any glass beverage or food container within 50 feet of any navigable waterway as defined under RSMO 306.325(1). (36 CFR 261.58cc)
12. Possessing any glass beverage or food container within the designated swimming beach at Council Bluff Lake. (36 CFR 261.58cc) 2

15. The use or possession of bicycle, mountain bikes or horses on trails on which they are prohibited by posted sign. (36 CFR 261.55c)
16. Operating or using any internal or external combustion engine without a spark arresting device property installed, maintained and in effective working order meeting Department of Agriculture, Forest Service Standard 5100.1a. (36 CFR 261.52j)
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:
1. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
2. Persons with a permit specifically authorizing the otherwise prohibited act or omission. These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.
A violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both (16 USC 551 and 18 USC 3559, 3571, and 3581).
