Forest Order

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. Part 261, Subpart B, the following acts are prohibited on certain National Forest System lands within the Dillon Ranger District of the White River National Forest in Summit County, Colorado, which are described below and shown on the attached maps incorporated into this Order as Exhibits A, B, and C (the “Restricted Areas”). 

The Restricted Area includes the portions of: the Rock Creek Area (Sections 27, 28, 29, and 33, Township 3S, Range 78W; Sections 4, 5, 6, 7, 8, 9, and 18, Township 4S, Range 79W) shown in red on Exhibit A; the portions of the Blue River Area (Sections 15, 16, 17, 18, 19, 29, 21, 22, 23, 26, 27, 28, 29, and 30, Township 7S, Range 77W; Sections 22, 23, 24, 25, 26, 27, 34, 35, and 36, Township 7S, Range 78W ) shown in red on Exhibit B; and Peru Creek Area (Sections 12,13,14,22, 23, 24, 25, 26, 27, 35, and 36, Township 5S, Range 76W, Sections 19, 20, 29, 30, Township 5S, Range 75W) shown in red on Exhibit C. 

The purpose of this Order is to protect natural resources and public safety due to high levels of dispersed recreation. 

 

PROHIBITIONS: 

1. Camping in the Restricted Area, unless camping in a designated dispersed campsite identified on Exhibits A, B, and C, and posted with signs identifying the site as open for camping. 36 C.F.R. § 261.58(e). 

2. Possessing or storing unattended food, refuse, cooking equipment, cooking utensils, or coolers in the Restricted Area, unless those items are in bear-resistant containers or inside vehicles in sealed containers. 36 C.F.R. § 261.58(cc). 

 

EXEMPTIONS: 

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order: 

1) Any federal, state or local officer, or member of an organized rescue or firefighting force, in the performance of an official duty; and 

2) Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this Order. 

This Order becomes effective at 12:01 am on November 9, 2020 and remains in effect until December 31, 2025 or until rescinded, whichever event occurs first.

A violation of the prohibitions in this Order is punishable as a Class B misdemeanor by a fine of not more than $5,000 for an individual or $10,000 for a legal entity other than an individual, or imprisonment for not more than 6 months, or both. (16 U.S.C. § 551 and 18 U.S.C. §§ 3559 and 3571)
