PROHIBITIONS

Pursuant to 16 USC§551 and 36 CFR§261.50(a), the following are prohibited on the National Forest System (NFS) lands in the Eagle-Holy Cross Ranger District, White River National Forest, described below and shown on the attached maps incorporated into this Order as Exhibits A and B (the “Described Area”):

  1. Camping in the Described Area. 36 C.F.R. § 261.58(e).
  2. Building, maintaining, attending or using a fire, campfire, or stove fire except in campgrounds and dispersed campsites designated and provided by the Forest Service. 36 C.F.R. § 261.52(a).

EXEMPTIONS

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

  1. Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (2).
  2. Any Federal, State, or Local Officer, or member of an organized rescue or firefighting force in the performance of an official duty.

DESCRIBED AREA

The Described Area is the following NFS lands:

  1. As shown on Exhibit A:
    • Yeoman Park Described Area – All NFS lands within ¼ mile outside of the Yeoman Park Campground.
    • Fulford Cave Described Area – All NFS lands within ¼ mile outside of the Fulford Cave Campground
    • Deep Lake Described Area – All NFS lands within ¼ mile outside of the Deep Lake Campground and Day Use Area.
    • Colorow Creek Described Area – All NFS lands within ¼ mile of NFS Road 422.
    • West Lake Creek Described Area – All NFS lands within ¼ mile of NFS Road 423, beginning at Eagle County Road 25 and ending at the Baryeta Cabins.
    • Grizzly Creek Described Area – All NFS lands within ¼ mile of the Grizzly Creek Trailhead.
  2. As shown on Exhibit B:
    • Gore Creek Described Area – All NFS lands within ¼ mile of Gore Creek Campground and the Vail Pass Recreation Path (NFS Trail 49) between Gore Creek Campground and Vail Pass.
    • Hornsilver Described Area – All NFS lands within ¼ mile outside of the Hornsilver Campground.
    • Halfmoon Described Area – All NFS lands within ¼ mile outside of the Halfmoon Campground.
    • Homestake Described Area – All NFS lands within ¼ mile outside of the Gold Park Campground and within ¼ mile of NFS Roads 703, 703.1C, 703.2B, 704, and 727, except in sites designated and provided by the Forest Service.
    • Piney Described Area – All NFS lands within ¼ mile of NFS Road 701, except in sites designated and provided by the Forest Service.
    • June and Berry Creek Described Area – NFS lands within ¼ mile of the entirety of NFS Roads 717.1A, 717.1B, and 774. NFS Lands within ¼ mile of NFS Road 717 beginning at mile point 0 and ending at mile point 1.0. NFS Lands within ¼ mile of NFS Road 780 beginning at mile point 0 and ending at mile point 1.4.
    • Metcalf Described Area – NFS lands within ¼ mile of NFS Road 779 beginning at mile point 0 and ending at mile point 0.6.
    • Red Sandstone Described Area – All NFS lands within ¼ mile of NFS Road 700, Red Sandstone Road, beginning at mile point 0 and ending at mile point 2.7.
    • Two Elk Road Described Area – All NFS lands within ¼ mile of NFS Road 762, Two Elk Road.
    • Camp Hale Described Area – All NFS lands within the Camp Hale Historic Area.
    • Grouse Creek Trailhead, which is located in Section 27, Township 5 South, Range 81 West, 6th P.M.
    • Spraddle Creek Trailhead, which is described as the parking area at the end of NFS Road 737 outside the gate, located in Section 5, Township 5 South, Range 80 West, 6th P.M.

PURPOSE

The purpose of this Order is to protect natural resources.
 

IMPLEMENTATION

  1. This Order shall be in effect from January 1, 2025, at 12:01 AM through December 31, 2027, at 11:59 PM, unless rescinded.
  2. Maps identifying the Described Areas are attached and made part of this Order as Exhibits A and B.
  3. Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions.
  4. A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and 3581.

  6. This Order supersedes UFC-WRNF-2024-06 and UFC-WRNF-2024-05 prohibiting the same or similar acts in the same Described Areas.
