Forest Order

Pursuant to 16 U.S.C. § 551 and 36 CFR § 261.50(a), the following acts are prohibited on the National Forest System (NFS) lands in the White River National Forest described below and shown on the attached maps incorporated into this Order as Exhibits A – C (the “Restricted Areas”). The purpose of this Order is to protect natural resources and public safety. 
 

RESTRICTED AREAS 

The Restricted Areas are located in the Eagle-Holy Cross Ranger District in Eagle and Summit Counties and are further described as: 

1. Grouse Creek Trailhead, which is located in T. 5 S, R. 81 W, Sec. 27, 6th P.M. (Exhibit A) 

2. The parking area at the end of NFSR 737 outside the gate, Spraddle Creek Road, which is located in T. 5S, R. 80 West, Sec. 5, 6th P.M (Exhibit B) 

3. Gore Creek Recreation Path/Black Lakes Area, which is the (Paved Recreation path paralleling Interstate 70 beginning at East Vail Bighorn Road and ending at the top of Vail Pass including the Black Lakes area. (Exhibit C) 

 

PROHIBITIONS 

1. Building, maintaining, attending, or using a fire, campfire, or stove fire. 36 CFR § 261.52(a) 

2. Camping. 36 CFR § 261.58(e) 

3. Parking or leaving a vehicle in violation of posted instructions, which prohibit overnight parking: 

  • a. From November 23 to April 30 at the Grouse Creek Trailhead;
  • b. From May 1 to September 1 at the Spraddle Creek Road, NFSR 737; and
  • c. From November 15 to May 21 at the Gore Creek Recreation Path/Black Lakes Area, except in designated parking for winter hut use. 36 CFR § 261.58(g). 


EXEMPTIONS 

Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this Order: 

1. Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this Order. 

2. Any Federal, State, or Local officer or member of an organized rescue or firefighting force in the performance of an official duty. 

This Order becomes effective at 12:01am on April 7, 2022 and remains in effect until December 31, 2028, or until rescinded, which ever event occurs first.

A violation of these prohibitions is punishable as a Class B misdemeanor, by a fine of not more than $5000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC § 551 and 18 USC §§ 3559, 3571, 3581.
