Forest Order

Pursuant to 16 U.S.C. § 551 and 36 CFR § 261.50(a), the following acts are prohibited on the National Forest System (NFS) lands within the White River National Forest described below and shown on the attached maps incorporated into this Order as Exhibits A-D (the “Restricted Areas”). The purpose of this Order is to protect natural resources and public safety.

 

RESTRICTED AREAS 

The Restricted Areas are located in the Eagle-Holy Cross Ranger District in Eagle County, Colorado and include: 

1. Yeoman Park – T.6S, R83W, Sec 27, 6 th P.M. as shown on Exhibit A 

2. Mount of the Holy Cross Overlook – T6S, R.79W., Sec 6, 6th P.M. as shown on Exhibit B 

3. Piney Designated Dispersed Sites – T. 4S., R 81W., Secs 22, 23, and 14, 6th P.M. as shown on Exhibit C 

4. Homestake Creek Drainage - T. 7S, R81W, Secs 5, 6, 7, 12, 13, 20, 22, 23, 24, 27, 28, 29, 30, 32, & 34. 6th P.M. and T. 8S, R81W, Secs 5 & 6, 6th P.M. as shown on Exhibit D. Corresponds to 300’ dispersed camping allowance detailed on annual Motor Vehicle Use Maps 36 C.F.R. 261.13 

 

PROHIBITIONS 

1. Using the Restricted Areas by more than the following people per group: 

  • a. 10 people per group at Yeoman Park from May 21 to November 22 each year (Exhibit A);
  • b. 40 people per group at the Mount of Holy Cross Overlook from June 21 to November 22 each year (Exhibit B);
  • c. 15 people per group in the Piney Designated Dispersed Sites from June 21 to November 22 each year (Exhibit C); and
  • d. 40 people in the Homestake Creek Drainage from May 21 to November 22 each year (Exhibit D). 


EXEMPTIONS 

Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this Order: 

1. Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this Order. 

2. Any Federal, State, or Local officer or member of an organized rescue or firefighting force in the performance of an official duty. 

This Order becomes effective at 12:01 a.m. on April 7, 2022, and will remain in effect until December 31, 2028, or until rescinded, whichever event occurs first.

A violation of these prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC § 551 and 18 USC §§ 3559, 3571, 3581.
