Forest Order

Pursuant to 16 United States Code (U.S.C.) § 551 and 36 Code of Federal Regulations (C.F.R.) § 261.50(a), the following acts are prohibited within the Hunter-Frying Pan Wilderness on the Aspen-Sopris Ranger Districts of the White River National Forest, in Pitkin County, State of Colorado, hereinafter referred to as the Restricted Area. The Restricted Area is depicted on the attached map, hereby incorporated into this Order as Exhibits A. 

This Order is necessary to protect the wilderness resource and to manage recreational use within the Hunter-Frying Pan Wilderness. 

 

PROHIBITIONS: 

1. Entering or being in the restricted area with more than 15 people per group, and a maximum combination of 25 people and pack or saddle animals in any one group. 36 C.F.R. §261. 58(f). 

2. Camping within one hundred (100) feet of any lake, stream, National Forest System Trail, or any " No Camping" or "Wilderness Restoration Site" sign. 36 C.F.R. §261.58(e). 

3. Building, maintaining, attending, or using a campfire: 

  • a) within one hundred (100) feet of any lake, stream, or National Forest System Trail;
  • b) within ¼ mile of, or above treeline. 36 C.F.R. §261.52(a) 

4. Storing equipment, personal property, or supplies for longer than 72 hours. 36 C.F.R. §26 l.57(f). 

5. Hitching, tethering or hobbling any pack or saddle animal within one hundred (100) feet of any lake, stream, or National Forest System Trail. 36 C.F.R. §261.58(aa). 

6. Possessing a dog or other animal that is uncontrolled, harassing wildlife or people, or damaging property. 36 C.F.R. §261.58(s). 

7. Possessing, storing or transporting any plant material, such as hay or straw. NOTE: Exceptions are allowed for livestock feed that has been processed through chemical or mechanical means in a manner that will destroy viable seeds. Examples of allowed material include pelletized feed and rolled grains. 36 C.F.R. §261.58(t). 

8. Possessing or using a wagon, cart or other vehicle including a wheelbarrow or game cart. 36 C.F.R. §261.57(h). 

9. Shortcutting a switchback in a trail. 36 C.F.R. §261.55(e). 2 Order #: WRNF#2021-01 

 

EXEMPTIONS:

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this order: 

1. Persons with a Forest Service permit specifically authorizing the otherwise prohibited act or omission. 

2. Any Federal, state, or local officer, or member of an organized rescue or firefighting force, in the performance of an official duty. 

 

This Order shall remain in effect until rescinded, or until December 31, 2025, whichever event occurs first. 

This Order supersedes, replaces and rescinds Order #: 2015-03. Done at Glenwood Springs, CO, this 15th day of January, 2021.

Violations of these regulations is punishable as a Class B misdemeanor, by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six (6) months, or both. 16 U.S.C. § 551, and 18 U.S.C. §§ 3559 and 3571.
