Forest Order

PROHIBITIONS

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a) and (b), the following acts are prohibited in the area described in this Order (the “Restricted Area”) and as depicted on the attached map, hereby incorporated into this Order as Exhibit A, within the Tonto National Forest, Maricopa, Gila, Yavapai, and Pinal Counties, State of Arizona.

  1. Camping for more than fourteen (14) days in a thirty-day period. 36 C.F.R. §261.58(a).
  2. Shortcutting a switchback in a trail. 36 C.F.R. § 261.55(e).
  3. Parking or leaving a vehicle in violation of posted instructions. 36 C.F.R. §261.58(g).
  4. Parking or leaving vehicles outside a parking space assigned to one's own camp unit. 36 C.F.R. §261.58(h).
  5. Riding, hitching, tethering, or hobbling a horse or other saddle or pack animal in violation of posted instructions. 36 C.F.R. § 261.58(aa).
  6. Camping at trailheads. 36 C.F.R. § 261.58(e).
  7. Possessing an alcoholic beverage in violation of Arizona State Law (ARS 4-244.9). 36 C.F.R. § 261.58(bb).
  8. Being publicly nude. 36 C.F.R. § 261.58(j).

EXEMPTIONS

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from the provisions of this Order: Order Number: 03-12-00-22-04

  1. Persons with a written Forest Service authorization specifically exempting them from the effect of this Order.
  2. Any Federal, State, or local officer, or member of any organized rescue or fire fighting force in the performance of an official duty.

RESTRICTED AREA

The Restricted Area consists of all National Forest System lands, waters, roads, and trails within the exterior boundaries of the Tonto National Forest, as depicted in Exhibit A of this Order.

PURPOSE

The purpose of this Order is to protect public health and safety, prevent user conflicts, and conserve forest resources.

IMPLEMENTATION

  1. The prohibitions contained in this Order shall be effective on February 19, 2022 and will remain in effect until February 19, 2026.
  2. A map identifying the Restricted Area is attached and made part of this Order as Exhibit A. For a digital version of the Order map, navigate to https://www.fs.usda.gov/r03/tonto/alerts.
  3. Any violation of these prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals or $10,000 for organizations, or by imprisonment for not more than six (6) months, or both (see 16 U.S.C. 551, 18 U.S.C. 3571(b)(6), 18 U.S.C. 3581(b)(7)).
