POSSESSION OF CONTROLLED SUBSTANCE(S) PROHIBITED
PROIDBITIONS:
Pursuant to Title 36 CFR 261.50 (a) and (b) the following acts are prohibited on the National Forest System lands as described in this Order, all lands affected are located within the Uinta-Wasatch-Cache National Forest boundaries. This Order is in effect starting February 12, 2020 until February 12, 2030 or until further notice.
- Possessing, storing, holding, using or transporting a cannabis plant(s) or any element of a cannabis plant or any substance derived from the manufacture of a cannabis plant less than 1 ounce in weight, as outlined in the Federal Controlled Substance Act listed in (21 U.S.C. 812 (c)(c)(l0) is in violation of36 CFR261.58(t).
EXEMPTIONS:
Pursuant to 36 CFR 261.50 (e) the following persons are exempt from this order:
- Any Federal, State, or local law enforcement officer in the performance of an official duty.
AREA DESCRIBED:
The area within the boundaries of the Uinta-Wasatch-Cache National Forests, as shown on the attached map.
DEFINITIONS:
21 USC 802 16(A) Subject to subparagraph (B), the term "marihuana" means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin. (B) The term "marihuana" does not include-(i) hemp, as defined in section 163 9o of title 7; or (ii) the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks ( except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.
PURPOSE:
The purpose of this order is to protect public and employee health and safety within the National Forests.
IMPLEMENTATION:
- This Order will be in effect when signed February 12, 2020 and shall remain in effect until February 12, 2030 or until rescinded.
- Violation of the above prohibition(s) is punishable by a fine of not more than $5,000
for an individual, or $10,000 for an organization and/or imprisonment for not more
than 6months. [Title 16 USC 551, Title 18 USC 3571(b) (6), Title 18 USC 3581(b) (7)].

- This Order supersedes any previous Order(s) prohibiting the same, or similar acts prohibited by this Order in the areas (and/or roads or trails) covered by this Order.
