The final permanent recreational shooting order, which replaces an emergency order issued under the Dingell Act, addresses public safety concerns associated with recreational shooting in this 34,018-acre, narrow watershed that experiences high visitation due to its proximity to Bozeman, Montana.

    This order will be effective on August 21, 2024 at 08:00 and shall remain in effect until it is recinded.

FINAL PERMANENT RECREATIONAL SHOOTING ORDER

 

 

PROHIBITION

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following act is prohibited on National Forest System (NFS) lands in the Hyalite Creek Drainage in the Bozeman Ranger District Custer Gallatin National Forest, described in detail below and shown on the attached map incorporated into this Order as Appendix A, hereinafter referred to as the "Described Area":

 

Discharging a firearm, air rifle, or gas gun.

36 C.F.R. § 261.58 (m).

 

EXEMPTIONS

 

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

 

  1. Persons in possession of Forest Service form FS-7700-48, Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order, specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (e)(2).
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  3. Persons in possession of a valid State of Montana hunting license who are hunting in compliance with Montana law.

 

DESCRIBED AREA

The Described Area includes the following NFS lands located in Gallatin County, Montana:

from the Custer Gallatin National Forest boundary in Section 18 T3S, R6E south, along the hydrological divide between the Bozeman Creek Drainage and Hyalite Creek


 

 

Drainage to Hyalite Peak, then generally north along the hydrological divide between the Hyalite Creek Drainage and South Cottonwood Creek Drainage to the Custer Gallatin National Forest boundary in the northeast corner of Section 22, T3S, R5E, then following the NFS property boundary east, south, east and north to the Custer Gallatin National Forest boundary in Section 14, then east along the Custer Gallatin National Forest boundary to the point of origin in Section 18.

 

 

IMPLEMENTATION

 

  1. This Order will be effective on August 21st, 2024, at 08:00 and shall remain in effect until it is rescinded.

 

  1. A map of the Described Area is incorporated into this Order as Appendix A.

 

  1. Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions.
  2. A violation of this prohibition is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C.

§§ 3559, 3571, 3581.
