PROHIBITIONS Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a) and (b), the following are prohibited on the National Forest System (NFS) lands, roads, and trails in the Boulder Ranger District, Arapaho and Roosevelt National Forests, described below and shown on the attached map incorporated into this Order as Exhibit A (the “Described Area, Roads, and Trails”): 1. Camping outside of a designated Forest Service campsite posted with signs. 36 C.F.R. § 261.58(e). 2. Parking or leaving a vehicle in violation of posted instructions. 36 C.F.R. § 261.58(g). 3. Igniting, building, maintaining, attending, or using a fire (including fires fueled by charcoal or briquettes) outside of a permanent metal or concrete fire pit or grate that the Forest Service has installed and maintained at its developed recreation sites (campgrounds and picnic areas). 36 C.F.R. § 261.52(a).
EXEMPTIONS Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order: 1. Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (2). 2. Any Federal, State, or Local Officer, or member of an organized rescue or firefighting force in the performance of an official duty.
DESCRIBED AREA, ROADS, AND TRAILS The Described Area is known as the “Gross Reservoir/Winiger Ridge Area” and is located in Sections 13, 14, 23, and 24, Township 1 South, Range 72 West, 6th P.M., and Sections 18 and 19, Township 1 South, Range 71 West, 6th P.M. It includes all NFS lands within the following boundaries: beginning at the start of NFS road 97.1 (Gross Reservoir Road) Order Number: # ARP-BRD-2023-02 the closure follows the NFS land boundary north then west then north to the border of Section 23. Following the north border of Section 23 the boundary moves east then north and east into Section 14 and 13. In Section 13 the boundary intersects with County Road 68 as it travels north then intersects the road again as it moves east, following the NFS land boundary into Section 18. The described area boundary includes all NFS land north of County Road 68J and extends to the northern boundary of Section 18. The boundary extends east to the Section 17 west boundary then moves west and south and east again to the border of Section 17, as to exclude non-NFS land in the east portion of Section 18. The boundary moves south into Section 19 into the Gross Reservoir capturing all NFS land in Section 19, including the small portion of land on the southeast side of the Reservoir. The described area moves west following the southern borders of Sections 19, 24, and 23. At the west boundary of Section 23, the described area moves north and northeast, following the NFS land boundary until it terminates at the start of NFS road 97.1. The Described Roads and Trails are all NFS roads and trails within the Described Area: 1. NFS Roads: Winiger Ridge Road and Spurs (359.1, 359.1A, 359.1P, 359.1T), Gross Reservoir Road (97.1), and NFS Road 68.2B 2. NFS Trails: 852 (Forsythe Canyon trail systems)
PURPOSE The purpose of this Order is to protect public health and safety and natural resources.
IMPLEMENTATION 1. This Order shall be in effect from May 12, 2023 at 12:01 AM through May 12, 2028 at 11:59 PM, unless rescinded. 2. A map identifying the Described Area, Roads, and Trails is attached and made part of this Order as Exhibit A. Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions. 4. A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and 3581. 5.
