OCCUPANCY AND USE

A. PROHIBITIONS 

Pursuant to Title 36 CFR 261.50(a) and (b) the following acts described in this order are prohibited within the Fishlake National Forest. 

1. 36 CFR 261.58(a) Camping in the same developed recreation site for a period in excess of 16 consecutive days or for more than 16 days in a 30-day period. 

2. 36 CFR 261.58(a) Camping in the same location, or within 5 miles of the same location, for more than 16 consecutive days or for more than 16 days in a 30-day period. 

3. 36. CFR 261.58(e) Camping in any area posted with “No Camping” signs. 

4. 36 CFR 261.58(g) Parking or leaving a vehicle in violation of posted instructions. 

B. EXEMPTIONS 

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order. 

1. Persons with a special use authorization (including grazing) or other Forest Service authorization specifically exempting them from the effect of this Order 

2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty. 

3. Federal or State administrative personnel in the performance of an official duty. 

C. DEFINITIONS 

Camping is defined as the temporary use of National Forest system land for the purpose of overnight occupancy without a permanently fixed structure. 36 CFR 261.2. A site is considered occupied if camping equipment is present. 

Camping Equipment is defined as personal property used in or suitable for camping, and includes any vehicle used for the transportation and all equipment in possession of a person camping. 36 CFR 261.2 

D. PURPOSE The purpose of this Order is to provide direction and enforcement across the Fishlake National Forest pertaining to camping. 

E. IMPLEMENTATION 

1. This Order will be in effect when signed and shall remain in effect until February 5, 2030, or rescinded, whichever occurs first. 

2. Further information regarding this Order may be obtained at the Fishlake National Forest Office, (435) 896-9233. 

3. This Order supersedes any previous Order(s) prohibiting the same, or similar acts prohibited by this Order. 

A violation of these prohibitions is punishable as a class B misdemeanor by a fine of not more than $5,000 for an individual or $10,000 for an organization and/or imprisonment of not more than 6 months [16 USC 551, 18 USC 3559, 3571, 3581].
