  • Beattie Gulch Area Shooting Closure

    The purpose of this order is to protect public health and safety. The closed area is in close proximity to private land and residences and the frequently traveled Old Yellowstone Trail South county road. The closure is a permanent closure as described under Section 4103 of the John D. Dingell, Jr. Conservation, Management, and Recreation Act (Public Law 116-9). It is necessary to ensure public health and safety on NFS lands immediately adjacent to private land to the North. This closure combined with existing federal shooting restrictions (36 CFR 261.10 Occupancy and Use (d)(1)) will provide for enhanced public safety.

    IMPLEMENTATION: This order will be in effect year round beginning on date of signature and in effect until rescinded.

FOREST ORDER

Beattie Gulch Area

 

Pursuant to 16 U.S.C. Â§ 551, 36 C.F.R. Â§ 261.50 (a),(b) and 261.58(m) the following acts are prohibited on the Gardiner Ranger District, Custer Gallatin National Forest:

 

PROHIBITION:

 

1. Discharging a firearm, air rifle or gas gun [36 C.F.R. Â§ 261.58 (m)].

 

AREA CLOSURE DESCRIPTION:

The closure applies to all National Forest System (NFS) lands including roads and trails, depicted on the attached map (Attachment A) also known as the “Beattie Gulch Clean Zone”.

 

PURPOSE:

The purpose of this order is to protect public health and safety. The closed area is in close proximity to private land and residences and the frequently traveled Old Yellowstone Trail South county road. IMPLEMENTATION:

This order will be in effect year round beginning on date of signature and in effect until rescinded. These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.


 

EXEMPTIONS:

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:

  1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

 

 

VIOLATION:

Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571(b)(6) and 3581(b)(7).
