Forest Order

Pursuant to Title 16, United States Code, § 551, 36 Code of Federal Regulations, §§ 261.50(a) & (b), the following acts are prohibited on all National Forest System lands within the Boulder Ranger District of the Arapaho and Roosevelt National Forests that are located in Boulder County, Colorado (the “Restricted Area”). The Restricted Area is defined as The Brainard Lake Recreation Area located in T. 2 N., R. 73 W., sections 34, 35 & 36, and T. 1 N., R. 73 W., sections 2,3,4,5,8,9,10 & 11, as depicted on the attached map, hereby incorporated into this Order as Exhibit A. 

PROHIBITIONS: 1. Possessing, storing or transporting a horse on the following trails: 36 CFR § 261.58(s) 814.3 Brainard Lake Snowshoe 802 Little Raven Extension 802.1 Little Raven 814.1 Waldrop 814.2 CMC 907 Pawnee Pass 907.1A Jean Lunning 907.2 Niwot Cutoff 909 South Saint Vrain south and west of the junction with the Sourdough Trail 909.1 Brainard Lake Cutoff 909.2 CMC Cabin Cutoff 911 Beaver Creek 912 Mitchell Lake 2. Using any motor vehicle on the following trails: 36 CFR § 261.55(b) 814.3 Brainard Lake Snowshoe 802 Little Raven Extension 802.1 Little Raven 814.1 Waldrop 814.2 CMC 835 Sourdough 907 Pawnee Pass 907.1AJean Lunning 907.2 Niwot Cutoff 909 South Saint Vrain 909.1 Brainard Lake Cutoff 909.2 CMC Cabin Cutoff 911 Beaver Creek 912 Mitchell Lake 3. Discharging a firearm, air rifle or gas gun except for legal hunting purposes. 36 CFR § 261.58(m) 4. Being on a trail, when posted as closed. 36 CFR § 261.55(a) 5. Possessing or transporting a dog, unless on a hand-held leash, from May 1 through November 14. 36 CFR § 261.58(s) 6. Using any mode of transportation other than skis on the following trails from November 15 through April 30: 36 CFR § 261.55(c) 802.1 Little Raven 814.2 CMC 8. Camping within one-quarter mile of any developed recreation site or trailhead from November 15 through April 30, excepting Red Rock Lake. 36 CFR § 261.58(e) 9. Using any motor vehicle past seasonally closed gates on the following roads from November 15 through April 30: 36 CFR § 261.54(a) 112 Brainard Lake 232 Left Hand Park Reservoir 10. Using any motor vehicle on the north side of Brainard Lake on the Brainard Lake Road from west of the day use parking area to the junction of the two-way road: 36 CFR § 261.54 (a) 11. Parking or leaving a vehicle in violation of posted instructions: 36 CFR § 261.58 (g) 12. Camping within the Brainard Lake Recreation Area except north of the South St. Vrain Creek or within a developed campground: 36 CFR § 261.58 (e) 

EXEMPTIONS: Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this ORDER: 1. Persons with a permit specifically authorizing the otherwise prohibited act or omission; 2. Any Federal, State or Local officer or member of any organized rescue or fire fighting force in the performance of an official duty; 3. Any hunters using dogs for legal hunting purposes. 

The purpose of this order is to provide for public safety and protect natural resources. This Order shall be in effect beginning April 1, 2013 until rescinded.
