Lake Mary Occupancy and Use Prohibitions
PROHIBITIONS
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following are prohibited on the National Forest System (NFS) lands in the Flagstaff Ranger District in the Coconino National Forest, described below and shown on the attached map incorporated into this Order as Exhibit A (the “Described Area”):
- Building, maintaining, attending or using a fire, including charcoal and briquettes, outside a fire structure that is provided by the Forest Service. 36 C.F.R. § 261.52(a).
- Camping. 36 C.F.R. § 261.58(e).
- Using a Forest Service courtesy dock or launch ramp except for boating ingress, egress, loading, unloading, temporary docking, launching or retrieval not to exceed one hour duration. 36 C.F.R. § 261.58(b).
- Swimming or wading within 50 feet of any portion of a boat launch ramp or dock. 36 C.F.R. § 261.58(k).
DEFINITIONS
Fire Structure: A permanent metal or concrete structure, which is specifically designed for the purpose of containing a campfire or cooking fire that has been installed and maintained by the Forest Service.
EXEMPTIONS
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from Prohibition (1) of this Order (Building, maintaining, attending or using a fire, including charcoal and briquettes, outside a fire structure that is provided by the Forest Service. 36 C.F.R. § 261.52(a)):
- Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (2).
- Any Federal, State, or Local Officer, or member of an organized rescue or firefighting resource in the performance of an official duty.
- Persons using a stove, grill, or any fire implement that is solely fueled by pressurized liquid petroleum or pressurized liquid petroleum gas (LPG) fuels.
Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from Prohibition (2) of this Order (Camping. 36 C.F.R. § 261.58(e)), Prohibition (3) of this Order (Using a Forest Service courtesy dock or launch ramp except for boating ingress, egress, loading, unloading, temporary docking, launching or retrieval not to exceed one hour duration. 36 C.F.R. § 261.58(b)) and Prohibition (4) of this order (Swimming or wading within 50 feet of any portion of a boat launch ramp or dock. 36 C.F.R. § 261.58(k)):

DESCRIBED AREA
As depicted on the map in Exhibit A, the Described Area boundary includes all NFS lands between Forest Highway 3 (Lake Mary Road) and the shorelines of Lower and Upper Lake Mary beginning at the intersection of Forest Highway 3 and the Lower Lake Mary Dam (35° 6'46.73"N ; 111°34'58.66"W), continuing southeast to the intersection of Forest Highway 3 and Forest Road 9485C (35° 3'1.24"N ; 111°27'25.05"W), thence including all NFS lands within 200 feet west of Forest Highway 3 until the junction of Forest Highway 3 and Forest Road 651 (35° 1'41.54"N ; 111°27'12.48"W). The Described Area includes all boat ramps and floating docks within the Upper Lake Mary Day Use Area and The Narrows Day Use Area.
PURPOSE
The purpose of this Order is to preserve soil and watershed integrity, prevent wildfires, mitigate user conflicts, and protect public health and safety.
IMPLEMENTATION
- This Order shall be in effect from January 01, 2025, at 8:00 a.m. through January 01, 2027, at 8:00 a.m., unless rescinded.

- Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200-299, their meaning shall be determined by their plain language definitions.
- A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and 3581.

- This Order supersedes any previous Orders prohibiting the same or similar acts in the same Described Area.
