PROHIBITIONS:
Pursuant to 16 USC § 551 and 36 CFR 261.50(a), the following acts are prohibited annually beginning 12:01 A.M. the Saturday before Memorial Day through 11:59 on Labor Day on all National Forest System (NFS) lands within the Sawtooth National Recreation Area of the Sawtooth National Forest (excluding the Sawtooth Wilderness, Cecil D. Andrus-White Clouds Wilderness, and Hemingway-Boulders Wilderness) shown on the attached map incorporated into this Order as Exhibit B (the “Described Area”):
- Possessing or storing any food or refuse, unless it is acceptably stored or acceptably possessed as defined in Exhibit A. 36 CFR 261.58(cc)
- Possessing, storing, or transporting any bird, fish, or other animal, or parts thereof, unless it is acceptably stored or acceptably possessed as defined in Exhibit A. 36 CFR 261.58(s)
EXEMPTIONS:
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:
- Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this Order.
- Persons in possession of a state-issued black bear hunting license who are placing black bear baits in a manner that complies with Idaho State law and regulations.
- Any Federal or State officer placing baits to capture animals for research or management purposes as part of their official duties.
- Any member of the Shoshone Bannock Tribe member engaged in the exercise of rights under the Fort Bridger Treaty of 1868 or other Treaty rights.
PURPOSE:
The purpose of this Order is to protect public safety and wildlife by minimizing adverse interactions between bears and humans.
IMPLEMENTATION:
- This Order will be effective on the Saturday before Memorial Day, 2022 at 12:01 and shall remain in effect until the end of Labor Day, 2027 at 11:59 or until rescinded, whichever occurs first.
- A list of Definitions (Exhibit A) is attached and made part of this Order. Unless otherwise defined in this Order, the terms in this Order are defined in accordance with 36 C.F.R. § 261.2.
- A map identifying the Described Area (Exhibit B) is attached and made part of this Order.
- Any violation of the above prohibition(s) is punishable by a fine of not more than $5,000 for an individual, or $10,000 for an organization, and/or imprisonment for not more than six months. [16 USC § 551, 18 USC §§ 3559(a)(7), 3571(b)(6), 3581(b)(7).]
